Title:Zunajzakonska skupnost v Sloveniji in Severni Makedoniji : Primerjalna študija pravnih okvirov

Abstract:Magistrsko delo se osredotoča na primerjalno analizo pravne ureditve instituta zunajzakonske skupnosti v Republiki Sloveniji (Slovenija) in Republiki Severni Makedoniji (Makedonija). Začne se z definicijo in zgodovinskim pregledom družine in življenjskih skupnosti, nadaljuje pa s primerjavo pravnih definicij iz družinskega prava. V nadaljevanju so analizirana še druga področja, ki se dotikajo zunajzakonskih partnerjev, ter relevantna sodna praksa za to področje s sklepi in idejami, kako izboljšati trenutni položaj zunajzakonskih skupnosti v izbranih državah. Visok odstotek razvez, ekonomska neodvisnost, obredi in upravni postopki vodijo do tega, da sklenitev zakonske zveze ni prva izbira med mladimi, ki iščejo alternativne načine ureditve življenjske skupnosti. Ena najpogostejših alternativ je institut zunajzakonske skupnosti, vendar njegovo poznavanje, razumevanje, kdaj in kako nastane zunajzakonska skupnost ter kakšne so pravice in obveznosti, ki jih bosta imela zunajzakonska partnerja, med državljani teh držav ni dovolj poznano. Prispevek poskuša s primerjalno analizo podati osnovna znanja, ki bi jih državljan moral imeti o zunajzakonski skupnosti. Temeljita primerjalno pravna analiza, pri kateri so bili natančno upoštevani vidiki pozitivnega prava ter sodne prakse v obeh državah, je omogočila celovit pregled med pravnimi ureditvami. Bistvo analize je predstaviti razlike in podobnosti, ki obstajajo med državama, da bi državljane teh dveh držav seznanili s tem institutom. Čeprav sta bili obe državi del Socialistične federativne republike Jugoslavije (SFRJ), lahko ugotovimo, da je Republika Slovenija zunajzakonskim partnerjem priznavala in določila veliko več pravic in obveznosti kot Republika Severna Makedonija. Poleg tega imata obe državi še vedno problem z zunajzakonsko skupnostjo, ki predstavlja dodatno breme za sodišča, ker jo je treba dokazovati in ugotavljati v sodnem postopku. V prispevku je podana kritika in vizija izboljšanja pravnega okvira z namenom olajšanja dela sodnikov, zunajzakonskih partnerjev in drugih ter ustvarjanja boljšega pristopa za partnerje, ki bi želeli vzpostaviti zunajzakonsko skupnost.

Title:Cohabitation in Slovenia and North Macedonia : A Comparative Study of Legal Frameworks
Abstract:The master's thesis focuses on a comparative analysis of the legal regulation of the institution of cohabitation in the Republic of Slovenia (RS) and the Republic of North Macedonia (RSM). It begins with a definition and historical overview of the family and living communities, and continues with a comparison of legal definitions from family law. In the continuation, other areas that concern cohabiting partners, as well as relevant case law for this area, are analyzed, with conclusions and ideas on how to improve the current situation of cohabitation in the selected countries. The high percentage of divorces, economic independence, rituals, and administrative procedures lead to the fact that entering into marriage is not the first choice among young people, who are looking for alternative ways of organizing their living community. One of the most common alternatives is the institution of cohabitation, but its knowledge, understanding of when and how cohabitation arises, and what rights and obligations the cohabiting partners will have, are not sufficiently known among the citizens of these countries. The contribution attempts, through a comparative analysis, to provide the basic knowledge that a citizen should have about cohabitation. A thorough comparative legal analysis was conducted, in which aspects of positive law and case law in both countries were precisely considered, which enabled a comprehensive review between the legal regulations. The essence of the analysis is to present the differences and similarities that exist between the two countries, in order to familiarize the citizens of these two countries with this institution. Although both countries were part of the Socialist Federal Republic of Yugoslavia (SFRY), it can be observed that the Republic of Slovenia has recognized and determined many more rights and obligations to cohabiting partners compared to the Republic of North Macedonia. In addition, both countries still have problems with cohabitation, which represents an additional burden for the courts, as it must be proven and established in a judicial procedure. The contribution provides criticism and a vision for improving the legal framework with the aim of easing the work of judges, cohabiting partners, and others, as well as creating a better approach for partners who would like to establish a cohabitation.
