Abstract:
Povezane nepremičnine so pravni institut, s katerim je v pravni praksi mogoče rešiti nešteto situacij, ki bi brez instituta povezanih nepremičnin lahko ljudem povzročale veliko preglavic, saj na preprost način rešujejo prenos lastninske pravice na nepremičninah, na katerih se zaradi funkcionalne povezanosti vzpostavijo povezane nepremičnine. Problem glede vzpostavitve predstavlja trenutna zakonodaja, ki onemogoča vzpostavitev povezanih nepremičnin na nepremičninah, na katerih obstaja predkupna pravica, odkupna pravica ali prepoved odtujitve ali obremenitve v korist različnih upravičencev. Poseben problem predstavlja vzpostavitev povezanih nepremičnin med kmetijskimi in stavbnimi zemljišči, saj že zakonodaja določa drugačne predkupne upravičence. Vzpostavitev povezanih nepremičnin med kmetijskimi in stavbnimi zemljišči je pravno področje, ki zaradi svojih specifik potrebuje drugačno obravnavo in za katerega bo potrebna nadaljnja in podrobnejša zakonska opredelitev. Naslednja problematika, ki se pojavi v primeru vzpostavitve povezanih nepremičnin med kmetijskimi in stavbnimi zemljišči, je, da v primeru, kadar je kmetijsko zemljišče pomožno zemljišče, prenos lastninske pravice lahko pomeni zaobid kogentne specialne zakonodaje, ki za slednja velja.

Connected real estate of different purposeful use (agricultural and building lang)
Abstract:
Connected real estate properties represent a legal institute that addresses numerous challenges in legal practice, which, without this concept, could pose significant difficulties for individuals. It provides an efficient mechanism for transferring ownership rights over properties where functional connections necessitate the establishment of linked real estate properties. However, challenges arise due to current legislation, which prohibits the establishment of linked real estate on properties subject to preemption rights, repurchase rights, or restrictions on alienation or encumbrance in favor of various entitled parties. A particular issue emerges in the context of linking agricultural and building land, as existing legislation defines distinct preemptive entitlements for these property types. The creation of linked real estate between agricultural and building land requires special consideration due to its unique characteristics and necessitates further, detailed legal clarification. Additionally, an issue arises when agricultural land is considered auxiliary land; in such cases, the transfer of ownership rights may circumvent mandatory special legislation governing these properties.
