Title:PRAVNI REŽIMI IZVEDENIH STVARNIH PRAVIC NA NEPREMIČNINAH PO POSEBNIH PRAVNIH PREDPISIH

Abstract:Magistrsko delo obravnava pravne režime izvedenih stvarnih pravic na nepremičninah, s poudarkom na stavbni pravici in služnosti v javno korist, ki sta ključna pravna instrumenta za uporabo nepremičnin, namenjenih javnim in gospodarskim projektom. Uvedba teh pravic omogoča specifično rabo nepremičnin, pri čemer ni potrebno popolnoma odvzeti lastninske pravice lastniku, kar je pomembno pri posegih na zemljišča za potrebe infrastrukture in javnih storitev. V nalogi je poudarjeno, da novela Stvarnopravnega zakonika (SPZ-B) širi možnosti uporabe te pravice, saj omogoča ustanovitev stavbne pravice za nedoločen čas in predvideva možnost njene zastave. To pomeni dodatno fleksibilnost pri financiranju projektov ter večjo pravno stabilnost za imetnike stavbne pravice, saj se jim omogoča, da pod enakimi pogoji izvajajo projekte, ki jih prej zakon ni dopuščal. Stavbna pravica tako prinaša pravno orodje, ki lastnikom in investitorjem omogoča boljše upravljanje z nepremičninami, posebej pri rabi zemljišč javnega dobra, kot so javni trgi ali območja podzemnih garaž. Posebno mesto zavzema služnost v javno korist, ki je pomembna za infrastrukturo, kot so energetski in prometni objekti, kjer zakonodaja omogoča posege na zemljišča v javnem interesu. Služnost v javno korist se ustanavlja bodisi prostovoljno z dogovorom med lastnikom zemljišča in imetnikom pravice bodisi prisilno z upravno odločbo, kadar dogovor ni mogoč. Delo analizira pomen te možnosti, saj se s služnostjo v javno korist lahko zmanjša potreba po razlastitvi, kar omogoča učinkovitejšo realizacijo projektov javne infrastrukture. Delo preučuje tudi zakonodajne vire, kot so Zakon o urejanju prostora (ZUreP-3), Zakon o stvarnem premoženju države in samoupravnih lokalnih skupnosti (ZSPDSLS-1) in Energetski zakon (EZ-2), ki urejajo različne vidike teh pravic. Skozi delo je moč ugotoviti, da razlike med zakoni vplivajo na nadomestila, trajanje in prenosljivost pravic, kar lahko povzroči neskladje v pravnem položaju med lastniki zemljišč in nosilci infrastrukturnih projektov.

Title:LEGAL REGIMES OF DERIVATIVE RIGHTS IN REM ON REAL ESTATES ACCORDING TO SPECIAL LEGAL REGULATIONS
Abstract:This master's thesis examines the legal regimes of derivative rights in rem on real estate, focusing on building rights and servitudes for public benefit, which are key legal instruments for managing real estate intended for public and economic projects. A building right is a property right that permits the holder to construct or maintain a structure on someone else's property without acquiring ownership of the land. The thesis emphasizes that the amendment to the Law of Property Code (SPZ-B) expands the usability of this right, allowing for the establishment of a building right for an indefinite period and providing for the possibility of pledging the right. This expansion offers added flexibility in project financing and greater legal stability for holders of building rights, enabling them to carry out projects under conditions not previously permitted by law. Building rights thus serve as a legal tool that allows owners and investors to better manage real estate, especially in using public land areas, such as public squares or underground garage spaces. The servitude for public benefit occupies a special place, being crucial for infrastructure projects, such as energy and transportation facilities, where the law enables public interest interventions on land. Public benefit servitudes can be established either voluntarily through an agreement between the landowner and the right holder or compulsorily through an administrative decision when an agreement is not possible. The thesis analyzes the importance of this option, as servitudes for public benefit can reduce the need for expropriation, facilitating more efficient implementation of public infrastructure projects. The thesis also examines legislative sources such as the Spatial Management Act (ZUreP-3), the Physical Assets of the State and Local Government Act (ZSPDSLS-1), and the Energy Act (EZ-2), which regulate various aspects of these rights. Through this work, it is evident that differences between these laws affect compensation, duration, and transferability of the rights, which can lead to discrepancies in the legal standing of landowners and infrastructure project stakeholder.
