Title:Ureditev etažne lastnine po noveli SPZ-B ter primerjava z italijansko ureditvijo : magistrsko delo

Abstract:Magistrska naloga z naslovom »Ureditev etažne lastnine po noveli SPZ-B ter primerjava z italijansko ureditvijo« je namenjena predvsem lažjemu razumevanju razvoja instituta etažne lastnine na našem ozemlju, ter spremembam, ki so se čez leta uveljavile. Obenem magistrska naloga podrobno opredeljuje italijansko ureditev etažne lastnine in primerjavo le te z aktualno ureditvijo etažne lastnine v Republiki Sloveniji. Etažna lastnina je posebna vrsta lastninske pravice na delu stavbe. Sam pojem se je na našem ozemlju začel razvijati nekje v 50-tih letih prejšnjega stoletja. Proces uveljavitve je bil v veliki meri podvržen postopku nacionalizacije. Zaradi takšnih okoliščin so nastale posledice, ki se odražajo še danes. Etažna lastnina je sama po sebi vrsta lastninske pravice, ki je urejena v Stvarnopravnem zakoniku. Gre za lastništvo ene stavbe s strani različnih oseb, pri čemer je bistvena funkcionalna celota prostorov. K etažni lastnini vedno spada tudi solastnina na skupnih delih in napravah. Z novelo SPZ-B, ki je bila sprejeta leta 2020, se je v naš pravni sistem uvedel nov institut povezanih nepremičnin. SPZ-B je namenil novemu institutu celotno poglavje, v katerem opredeljuje pravila za nastanek povezanih nepremičnin, upravljanje povezanih nepremičnin ter prenehanje povezanih nepremičnin. Povezane nepremičnine lahko uvrstimo v poglavje pojavnosti lastninske pravice več oseb. Gre torej za upoštevanje potreb pri urejanju medsebojnih razmerij med lastniki nepremičnin, povezanih z načinom gradnje in urejanjem prostora. To so nepremičnine povezane z načinom gradnje in urejanjem prostora. Gre za nepremičnine, namenjene za skupno rabo več drugih nepremičnin oziroma funkcionalno povezavo dveh nepremičnin. Profesor Juhart je pri novem institutu izpostavil nekaj problemov, ki so neprimernost solastnine oziroma skupne lastnine kot osnovnega pravnega režima. Ločen pravni režim lahko pripelje do cepitve lastninske pravice ter do neučinkovitosti upravljanja. Zanimivo je, kako različno je lahko urejen enak pravni institut v dveh državah, ki ležita na enakem kontinentu, vendar sta imeli različen postopek razvoja. Italija ima v svojem civilnem zakoniku (Codice Civile) napredne določbe s področja etažne lastnine, ki jih je leta 2012, natančneje 12. novembra potrdil odbor za pravosodje (Commissione giustizia) Republiškega senata z novim besedilom zakona o stanovanjskih nepremičninah. Novo besedilo je v pravni red na novo vključilo dokaj inovativne ideje kasacijskega sodišča s področja večstanovanjskih stavb ter dodal nekatera popolnoma nova določila, katera so bila do te točke še nepoznana. Primerjava med ureditvijo v državi Italiji ter Sloveniji jasno prikaže pomanjkljivosti v našem pravnem sistemu, predvsem to, da nismo ažurni v prilagajanju pravne ureditve glede na hiter tehnološki napredek ter hiter napredek na področju gradnje.

Title:The regulation of condominium ownership under the amendment SPZ-B and comparison with italy
Abstract:The master’s thesis titled "The Regulation of Condominium Ownership under the SPZ-B Amendment and a Comparison with the Italy" is primarily aimed at facilitating a better understanding of the development of the condominium ownership institute in our region and the changes that have been introduced over time. Additionally, the thesis provides a detailed explanation of the Italian regulation of condominium ownership and compares it with the current regulation in the Republic of Slovenia. Condominium ownership is a specific form of property right over a part of a building. The concept began to develop in our region around the 1950s, with the process of its establishment being significantly influenced by nationalization procedures. These circumstances have led to consequences that are still evident today. Condominium ownership, as a subtype of property rights, is regulated by the Law of Property Code (Stvarnopravni zakonik - SPZ). Essentially, it refers to the ownership of a building by multiple persons, with the functional integrity of the premises being a key aspect. Condominium ownership inevitably includes co-ownership of common areas and facilities. The SPZ-B amendment, adopted in 2020, introduced a new institute of "connected real properties" into our legal system. The SPZ-B dedicated an entire chapter to this new institute, outlining the rules for the creation, management, and termination of connected real properties. Connected real properties can be categorized under the broader concept of ownership shared by multiple persons. They reflect the need to regulate relationships between property owners, especially in relation to construction methods and spatial planning. These properties are intended for the shared use of other properties or involve the functional connection between two properties. Professor Juhart highlighted several issues with this new institute, including the inadequacy of co-ownership or joint ownership as the basic legal regime, the risk of splitting ownership rights due to separate legal regimes, and inefficiencies in property management. It is interesting to observe how the same legal institute can be regulated differently in two countries located on the same continent, yet having undergone distinct development processes. Italy, in its Civil Code, has advanced provisions regarding condominium ownership, which were updated on November 12, 2012, when the Justice Committee (Commissione giustizia) of the Senate of the Republic approved the new text of the law on residential properties. The new text introduced innovative ideas from the Court of Cassation concerning multi-unit buildings and added completely new provisions that were previously unknown. The comparison between the Italian and Slovenian regulations clearly reveals the shortcomings of our legal system, particularly the lack of timely adaptation to rapid technological advancements and developments in the field of construction.
