Title:Pravica do prekinitve nosečnosti - primerjava slovenskega, hrvaškega in ameriškega pravnega sistema : magistrsko delo

Abstract:Tema o umetni prekinitvi nosečnosti – splavu še zmeraj po svetu ostaja tabu tema ter eno izmed najbolj razdvajajočih vprašanj v sodobni družbi, saj se na tem področju prepletajo različne družbene vrednote (pravica do življenja, pravica do telesne avtonomije), ki jih ljudje različno prioritiziramo. Vsekakor je razumevanje ter dojemanje abortusa močno povezano s političnimi, kulturnimi ter verskimi vrednotami in je to glavni razlog za oteženo dosego konsenza o ureditvi umetne prekinitve nosečnosti na globalni ravni. Ne glede na razlike v državnih ureditvah abortusa pa je pomembno, da se priznajo pravice ženskam do telesne avtonomije in se zagotavi tudi celovita podpora, kar vključuje dostop do zdravstvenih storitev, izobraževanja in morebitno socialno podporo. Na drugi strani pa je pomembno zaščititi tudi pravico do življenja, ki je prav tako ena izmed temeljnih pravic po vsem svetu. V ta namen so oblikovani različni koncepti po svetu, ki omogočajo ženskam svobodno odločitev o prekinitvi nosečnosti, hkrati pa preprečujejo, da bi že »živo bitje, ki se nahaja v telesu nosečnice« umrlo kot posledica umetne prekinitve nosečnosti. Tako slovenska in hrvaška ureditev denimo dovoljujeta umetno prekinitev nosečnosti na zahtevo nosečnice do dopolnjenega 10. tedna nosečnosti, kasneje pa le s soglasjem posebne komisije. Ameriška ureditev je za razliko od slovenske in hrvaške, urejena zelo neenotno, saj je zveznim državam prepuščeno, da same določajo, kako bodo uredile abortus, kar zagotavlja neenak položaj žensk v Združenih državah Amerike in jih prisiljuje, da potujejo v države, ki jim je storitev splava omogočena.

Title:Right to abortion - comparison among slovenian, croatian and american legal system
Abstract:Abortion is still a taboo subject worldwide and one of the most divisive issues in contemporary society, because it is an area where different social values (right to life, right to bodily autonomy) intersect and have different priorities. In any case, the understanding and perception of abortion is strongly linked to political, cultural and religious values, which is the main reason why it is difficult to reach a global consensus on abortion regulation. Notwithstanding the differences in national abortion regimes, it is important, that women's right to bodily autonomy is recognised and that they are provided with comprehensive support, including access to health services, education and possible social support. On the other hand, it is also important to protect the right to life, which is also a fundamental right throughout the world. To this end, various concepts have been developed around the world that allow women to freely decide to terminate their pregnancy, while preventing the "living being already inside the pregnant woman" from dying as a result of the abortion. For example, the Slovenian and Croatian regulations allow abortion at the request of the pregnant woman up to the 10th week of pregnancy, and after that only with the consent of a special commission. Unlike the Slovenian and Croatian regulations, the American regulation is very uneven, as the states are left to determine how to regulate abortion, which ensures an unequal position for women in the United States and forces them to travel to countries that allow abortion services to be provided.
