Title:Spolno izkoriščanje kot oblika trgovine z ljudmi v Jugovzhodni Evropi : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Trgovina z ljudmi je oblika sodobnega suženjstva, pri katerem posamezniki uporabijo različne vrste goljufije z namenom prisile osebe v delo in izvrševanje spolnih uslug. Trgovina z ljudmi ima več različnih oblik, osebe pa so lahko izkoriščene na različne načine. Najbolj poznana oblika je spolno izkoriščanje. Spolno izkoriščanje je definirano kot zloraba moči, zaupanja ter ranljivega položaja žrtve. Države, ki sestavljajo Jugovzhodno Evropo, priznavajo trgovino z ljudmi kot kaznivo dejanje v svojih zakonodajah, te pa so skladne s Protokolom Združenih narodov. Regijo Jugovzhodne Evrope sestavljajo Albanija, Bosna in Hercegovina, Bolgarija, Hrvaška, Grčija, Kosovo, Severna Makedonija, Črna Gora, Romunija, Srbija in Slovenija. Analiza iz leta 2022 je pokazala, da je prevladujoča oblika trgovine z ljudmi v državah Jugovzhodne Evrope spolno izkoriščanje. Za preučevanje problema smo se osredotočili na pregled strokovne literature, kjer smo pregledali uradne dokumente, ki so nam omogočili podrobnejši vpogled v zakonske akte in ukrepe, ki jih imajo države Jugovzhodne Evrope za boj proti trgovini z ljudmi in spolnemu izkoriščanju. Za boljši vpogled o številu žrtev trgovine z ljudmi in spolnega izkoriščanja smo naredili pregled statističnih baz. Tudi naša raziskava je pokazala, da je spolno izkoriščanje prevladujoča oblika trgovine z ljudmi v država Jugovzhodne Evrope. Najbolj ranljive skupine za spolno izkoriščanje so ženske in otroci. Albanija in Grčija sta zabeležili večje število žrtev trgovine z ljudmi, kar lahko povežemo z dejstvom, da imata omenjeni državi premalo razvitih členov v Kazenskem zakoniku. Države Jugovzhodne Evrope še zmeraj bijejo boj proti trgovini z ljudmi in imajo še zmeraj veliko prostora za izboljšanje in napredek pri boju z omenjeno problematiko. Nekatere države so uspešnejše kakor druge, kar se kaže v številu žrtev. V državah, kjer se število žrtev vsako leto veča oz. ostaja isto, bi bilo smiselno izvesti še nadaljnje raziskave, da se določi konkreten razlog in predlaga izboljšave. Države, ki imajo slab oz. pomanjkljiv kazenski zakonik in člene, ki opredeljujejo trgovino z ljudmi in spolno izkoriščanje, bi morale te nadgraditi in poostriti. Prav tako bi bilo smiselno zakonodajo nekaterih držav urediti tako, da bo ščitila žrtve in da jim bo tudi nudila možnosti za rehabilitacijo.

Title:Sexual exploitation as a form of human trafficking in Southeast Europe
Abstract:Human trafficking is a form of modern slavery in which individuals use various types of fraud with the aim of forcing a person to work and perform sexual services. Human trafficking takes many different forms, and people can be exploited in different ways. The most familiar form is sexual exploitation. Sexual exploitation is defined as the abuse of power, trust and vulnerable position of the victim. The countries that make up Southeast Europe recognize human trafficking as a criminal offense in their laws, which are in line with the United Nations Protocol. The Southeast Europe region consists of Albania, Bosnia and Herzegovina, Bulgaria, Croatia, Greece, Kosovo, Macedonia, Montenegro, Romania, Serbia and Slovenia. A 2022 analysis found that the predominant form of human trafficking in Southeastern European countries is sexual exploitation. To study the problem, we focused on a review of the professional literature, where we examined official documents that allowed us a more detailed insight into the legal acts and measures that the countries of Southeast Europe have in place to combat human trafficking and sexual exploitation. For a better insight into the number of victims of human trafficking and sexual exploitation, we made a review of statistical databases. Our research has shown us that sexual exploitation is the dominant form of human trafficking in Southeastern European countries. The most vulnerable groups for sexual exploitation were women and children. Albania and Greece recorded a higher number of victims of human trafficking, which can be linked to the fact that the mentioned countries have insufficiently developed articles in the Criminal Code. The countries of Southeast Europe are still fighting the fight against human trafficking and still have a lot of room for improvement and progress in the fight against the mentioned issue. Some countries are more successful than others, which is reflected in the number of victims. In countries where the number of victims increases every year or remains the same, it would be reasonable to carry out further research to determine the concrete reason and propose improvements. Countries that have bad or deficient criminal code and articles defining human trafficking and sexual exploitation should be upgraded and strengthened. It would also make sense to regulate the legislation of some countries in such a way that it protects victims and also offers them opportunities for rehabilitation.
