Abstract:Služnost je omejena stvarna pravica na tuji stvari, ki njenega imetnika upravičuje, da tujo stvar uporablja oziroma da od lastnika tuje stvari zahteva, da opusti določena ravnanja, ki bi mu sicer kot lastniku bila dovoljena. Institut služnosti je sicer klasičen stvarnopravni institut, katerega zgodovina sega celo v čas pred našim štetjem, v skoraj identični obliki, kot ga poznamo danes, pa se je razvil že v rimskem pravu. Služnosti so različnih vrst, med katerimi je v magistrskem delu posebna pozornost namenjena osebnim služnostim, medtem ko so ostale vrste, tj. stvarne služnosti, neprave stvarne služnosti in služnosti v javno korist, opisane le v osnovnem okviru njihovih temeljnih značilnosti. Glavnina magistrskega dela torej obsega obravnavo osebnih služnosti, katerih bistvena lastnost je, da pripadajo točno določeni osebi, v posledici tega pa niso podedljive in odsvojljive. Ne glede na dejstvo, da gre za zelo star in že davno pravno razdelan institut, se v pravni ureditvi še vedno pojavljajo določene dileme, ki so v magistrskem delu sistematično predstavljene in poglobljeno pojasnjene. Eno izmed pomembnih vprašanj, glede katerega je v teoriji zaslediti različna stališča, je vprašanje vsebine posameznih vrst osebnih služnosti oziroma v okviru tega zlasti vprašanje, ali tudi raba in služnost stanovanja vsebujeta upravičenje do uživanja stvari ali pa gre to upravičenje samo imetniku užitka. Magistrsko delo vsebuje odgovore na ta in številna druga vprašanja, med njimi tudi takšna, glede katerih v teoriji oziroma sodni praksi ni oblikovanega konsenza. Tako so v magistrskem delu natančno teoretično analizirani številni instituti v okviru osebnih služnosti, ob tem postavljeni v kontekst veljavne zakonske ureditve, mestoma pa pojasnjeni tudi s pomočjo sodne prakse in primerjalnopravne analize.

Title:Legal regulation of personal easements
Abstract:An easement is a limited right in rem over another's property which entitles the holder to use the property or to require the owner of the property to refrain from certain acts which he would otherwise be entitled to do as owner. The institution of an easement is a classical property-law institution whose history goes back to before the Common Era, but it developed in almost identical form as we know it today in Roman law. There are different types of easements, of which the Master's thesis pays particular attention to personal easements, while the other types, i.e. real easements, irregular real easements and easements in the public interest, are described only in the basic framework of their fundamental characteristics. The main part of the Master's thesis therefore deals with personal easements, the essential characteristic of which is that they belong to a specific person, and as a consequence are not inheritable or alienable. Notwithstanding the fact that this is a very old and long-established legal institution, certain dilemmas still arise in the legal system, which are systematically presented and thoroughly explained in the Master's thesis. One of the important issues on which there are different views in theory is the question of the content of the different types of personal easements, and in this context, particularly the question of whether the usus and habitatio also include a right to enjoy the fruits or whether this right is reserved to the holder of the usufruct. The Master's thesis provides answers to these and many other questions, including questions on which there is no consensus in theory or case-law. The Master's thesis therefore provides a detailed theoretical analysis of a number of institutions in the context of personal easements, setting them in the context of the current legal regime and, in some cases, clarifying them with the help of case-law and comparative law analysis.
