Abstract:Odvetništvo je spoštovanja vreden poklic, ki ima svoje korenine že v antičnih časih in se je ohranil do današnjih dni. Ugled odvetnikov kot pravnikov je skozi stoletja naraščal, medtem ko so razvoj družbe in spreminjajoči se načini življenja privedli do tega, da je odvetništvo postalo nepogrešljiva institucija. Beseda odvetnik ima dolgo zgodovino. Srečamo ga v staronemškem jeziku kot »anawalto«, v srednje visoki nemščini kot »an(e)walt«, v nizki nemščini se uporablja šele od 15. stoletja dalje. Poklic odvetnika kot zastopnika stranke je nastal in se razvijal skladno in skupno za razvojem države in prava. Po Ustavi RS je odvetništvo zasebnopravna služba, ki pa je povezana z zagotavljanjem javnega interesa oziroma javne koristi (137. člen Ustave: »Odvetništvo je kot del pravosodja samostojna in neodvisna služba, ki jo ureja zakon.«). Začetek modernega odvetništva na Slovenskem sega v čas marčne revolucije v Avstrijskem cesarstvu leta 1848 in sprememb, ki so ji sledile. S sprejetjem provizoričnega odvetniškega reda leta 1849 so se začele pozitivne spremembe, ki so odvetnikom in njihovim stanovskim organizacijam prinesle nove pravice, pa tudi jasno zapisane dolžnosti. Leta 1868 je v Avstro-Ogrski v veljavo stopil Advoaktenordnung, pravni predpis, ki je v monarhiji povsem preoblikoval poklic odvetnika. Zaradi Advoaktenordnunga so se avstro-ogrski odvetniki organizirali v deželne zbornice, ena od njih je bila tudi Kranjska odvetniška zbornica, ki je po prvi svetovni vojni nadaljevala pot kot Odvetniška zbornica v Ljubljani, Advokatska komora v Ljubljani in po drugi svetovni vojni ponovno kot Odvetniška Zbornica v Ljubljani ter končno kot Odvetniška zbornica Slovenije vstopila v novonastalo državo Slovenijo. Odvetniška zbornica je samoupravna oziroma avtonomna poklicna organizacija odvetnikov. Danes je v Odvetniški zbornici vpisanih več kot 2000 odvetnikov, vsako leto se pridruži med 120 in 150 novih odvetnikov.

Title:"Beschirmern vor vnrecht" - the role of the solicitor (lawyer)
Abstract:Lawyering is a respectable profession that has its roots in ancient times and has survived to the present day. The reputation of lawyers as jurists grew over the centuries, while the development of society and changing ways of life led to the legal profession becoming an indispensable institution. The word lawyer has a long history. It is found in Old German as »anawalto«, in Middle High German as »an(e)walt«, in Low German it is used only from the 15th century onwards. The profession of a lawyer as a client's representative arose and developed coherently and jointly with the development of the country and the law. According to the Constitution of the Republic of Slovenia, advocacy is a private law service, but it is related to the provision of public interest or public benefit (Article 137 of the Constitution: »As part of the judiciary, advocacy is an independent and independent service regulated by law.«). The beginning of modern law in Slovenia dates back to the March Revolution in the Austrian Empire in 1848 and the changes that followed it. With the adoption of the Provisional Bar Order in 1849, positive changes began, which brought new rights to lawyers and their associations, as well as clearly defined duties. In 1868, the Advoaktenordnung came into force in Austria-Hungary, a legal regulation that completely transformed the profession of lawyer in the monarchy. Due to the Advoaktenordnung, Austro-Hungarian lawyers organized themselves into regional chambers, one of which was the Carniola Bar Association, which continued its journey after the First World War as the Ljubljana Bar Association, the Ljubljana Chamber of Advocates, and after the Second World War again as the Bar Association in Ljubljana and finally entered the newly created state of Slovenia as the Bar Association of Slovenia. The Bar Association is a self-governing or autonomous professional organization of lawyers. Today, more than 2,000 lawyers are registered in the Bar Association, and between 120 and 150 new lawyers join each year.
