Title:Načini plačila odškodnine : magistrsko delo

Abstract:Magistrsko delo sistematično predstavlja analizo in primerjavo različnih načinov plačila odškodnine ter njihove uporabe v praksi. Delo povzema glavne ugotovitve in poudarja pomembnost razumevanja različnih načinov plačila odškodnine v praksi ter ponuja vpogled v pravne vidike ter sodno prakso s področja odškodninskega prava v Sloveniji in Nemčiji. Glavni cilj naloge je identificirati probleme in razlike med posameznimi načini plačila odškodnine, raziskati obstoječe načine plačila odškodnine ter ugotoviti, kateri načini se najpogosteje uporabljajo v praksi. Delo se posveča vrstam odškodnin, ki se plačujejo v denarnem znesku, z osredotočanjem na trenutek uveljavljanja odškodnine, kar je ključno za pravično in učinkovito določitev ustreznega načina plačila odškodnine. Vsaka vrsta škode ima svoje specifične elemente, ki vplivajo na oceno višine odškodnine in na način njenega plačila. Pomemben je tudi časovni vidik pri uveljavljanju odškodnine, saj nekatere vrste škode zahtevajo takojšnje uveljavljanje, medtem ko se lahko druge uveljavljajo v daljšem časovnem obdobju. Glede na časovni trenutek, v katerem se zahteva odškodnina, ločimo med preteklo, novo in bodočo škodo. To razlikovanje je ključno za določitev oblike odškodnine, ali bo ta v enkratnem znesku ali v obliki denarne rente. Pri konceptu ekvivalence delo obravnava izjemne primere, kdaj oškodovancu pripada in kdaj ne pripada pravica do izbire med vzpostavitvijo prejšnjega stanja ali denarno odškodnino. Pri konceptu satisfakcije delo obravnava analizo plačila, ki skuša nadomestiti moralno škodo, trpljenje ali neugodje, ki ga je utrpel oškodovanec zaradi škodnega dogodka. Vsak poseg v osebnostno pravico pa še ne pomeni nujno pravno priznane nepremoženjske škode, za katero bi se zahtevala satisfakcija, ampak je v teh primerih lahko mogoča in bolj smiselna kakšna druga oblika nedenarnega povračila. Delo obravnava analizo razmerja med odškodnino v enkratnem znesku in denarno rento. Odločitev med obema oblikama je odvisna od specifičnih okoliščin primera in vrste škode. Enkratni znesek omogoča hitro izplačilo celotne odškodnine, kar lahko oškodovancu pomaga pri izboljšanju finančnega položaja, poleg tega lahko poenostavi postopek izplačila in omogoča prosto razpolaganje z denarnim zneskom. Vendar pa obstajajo primeri, ko je način plačila v obliki periodičnih izplačil glede na okoliščine bolj primerno, še posebej pri bodoči škodi. Nazadnje delo predstavlja zanimivosti načinov plačila odškodnine v nemškem pravnem redu in primerjavo med višinami odškodnin za nepremoženjsko škodo v Sloveniji in Nemčiji. Podatki o višini nepremoženjskih škod v Sloveniji in Nemčiji so odvisni od več dejavnikov, kot so ureditev v pravnem redu države, sodna praksa, gospodarske, socialne ter kulturne razmere v državi. Nemci vedno, kadar je to mogoče, izberejo metodo enkratnega izplačila odškodnine, raziskave so pokazale, da naj bi do tega prišlo kar v 99 % vseh odškodninskih zahtev. Odškodnina naj bi, podobno kot v našem pravnem redu, v prvi vrsti obsegala povračilo škode v naravi in šele nato odškodnino. Znesek in trajanje denarne rente je odvisen od vrste nezmožnosti ter fizičnega in duševnega stanja oškodovanca, izjemoma se lahko dodeli oškodovancu renta tudi doživljenjsko.

Title:Methods of payment of compensation
Abstract:The master's thesis systematically presents the analysis and comparison of various methods of compensation payment and their application in practice. The paper summarizes the main findings and emphasizes the importance of understanding different methods of compensation payment in practice, offering insights into the legal aspects and judicial practices in the field of tort law in Slovenia and Germany. The main objective of the study is to identify problems and differences between individual methods of compensation payment, explore existing methods of compensation payment, and determine which methods are most commonly used in practice. The work focuses on types of compensation paid in monetary amounts, with a focus on the timing of asserting compensation, which is crucial for a fair and effective determination of the appropriate method of compensation payment. Each type of damage has its specific elements that influence the assessment of the amount of compensation and the method of its payment. The timing aspect is also important in asserting compensation, as some types of damage require immediate assertion, while others can be asserted over a longer period of time. Depending on the timing of the demand for compensation, we distinguish between past, present, and future damage. This differentiation is crucial for determining the form of compensation, whether it be a lump sum or monetary annuity. The thesis examines exceptional cases regarding the concept of equivalence – when the victim is and is not entitled to the right to choose between restoration to the previous state or monetary compensation. It also involves an analysis of payment aiming to compensate for moral damage, suffering, or discomfort suffered by the victim due to the harmful event, which falls under the concept of satisfaction. However, every infringement of personal rights does not necessarily constitute legally recognized non-pecuniary damage, for which satisfaction would be demanded. In these cases, another form of non-monetary compensation may be possible and prove more meaningful. The thesis analyzes the relationship between a lump-sum compensation and monetary annuity. The decision between the two forms depends on the specific circumstances of the case and the type of damage. A lump-sum payment allows for the quick disbursement of the entire compensation, which can assist the victim in improving their financial situation. Additionally, it may simplify the payment process and enable the recipient to freely manage the monetary amount. However, there are cases where periodic payments may be more appropriate depending on the circumstances, especially in the case of future damages. Finally, the thesis presents insights into the methods of compensation payment in the German legal system and compares the amounts of compensation for non-pecuniary damages in Slovenia and Germany. Data on the amounts of non-pecuniary damages in Slovenia and Germany depend on various factors, such as the legal framework of the country, judicial practice, economic, social, and cultural conditions. Germans typically opt for lump-sum compensation whenever possible, with research indicating that this occurs in 99% of all compensation claims. Similarly to our legal system, compensation in Germany primarily includes restitution for actual damages and only then monetary compensation. The amount and duration depend on the type of incapacity and the physical and mental condition of the victim, with exceptions allowing for a lifetime annuity.
