Title:Premoženjski režim zakoncev po uveljavitvi Družinskega zakonika : magistrsko delo

Abstract:Kljub spreminjanju družbe in družbenih vrednot ostaja zakonska zveza pomemben družbeni fenomen in družinskopravni institut. Zakonska zveza, ki jo danes pojmujemo predvsem kot nekaj romantičnega, je skozi svojo zgodovino predstavljala predvsem orodje za zagotovitev premoženjske varnosti. Tudi danes ima lahko sklenitev zakonske zveze pomemben vpliv na premoženjski položaj zakoncev. Do leta 2019, ko se je uporabljal Zakon o zakonski zvezi in družinskih razmerjih, je med zakoncema veljal obligatoren zakoniti premoženjski režim. Zakonca glede medsebojnih premoženjskih razmerij nista imela avtonomije. Teorija je pred sprejetjem Družinskega zakonika opozarjala na pomanjkljivosti obligatornega premoženjskega režima, ki glede na spreminjajočo se družbo ter drugačno pojmovanje lastnine v Ustavi Republike Slovenije ni bil več ustrezen. Ko se je leta 2019 začel uporabljati Družinski zakonik, je ta zakoncema omogočil, da odstopita od zakonitega premoženjskega režima ter lahko od tedaj svoja premoženjska razmerja urejata avtonomno s pogodbo o ureditvi premoženjskopravnih razmerij (včasih imenovana »ženitna pogodba«). Pogodba o ureditvi premoženjskopravnih razmerij mora biti sklenjena v obliki notarskega zapisa. Navedeno je sicer povezano z določenimi stroški, vendar so stroški za sklenitev tovrstne pogodbe bistveno nižji, kot če pogodba ni sklenjena in se premoženje ob razvezi zakonske zveze deli na podlagi sodne intervencije. Takšne pogodbe, ki v Sloveniji predstavljajo novost, v svetovnem merilu to niso, saj jih že dalj časa poznajo mnoge države celinske Evrope, njihovo zibelko pa predstavljajo Združene države Amerike. Namen magistrskega dela je seznaniti z učinkovitostjo sprememb na premoženjskopravnem področju zakoncev, ki jih je prinesel Družinski zakonik ter ugotoviti, kako so bile spremembe sprejete med teoretiki in v praksi. Prikazati želimo nove možnosti, ki jih na premoženjskopravnem področju slovensko pravo ponuja zakoncema tako v času trajanja zakonske zveze kot tudi v primeru njenega prenehanja.

Title:Matrimonial Property Regime after the adoption of the Family Code
Abstract:Despite changes in society and social values, marriage remains an important social phenomenon and family law institution. Marriage, which is nowadays seen mainly as something romantic, has throughout its history been primarily a tool to ensure financial security. Even today, the conclusion of a marriage can have a significant impact on the financial situation of the spouses. Until 2019, when the Marriage and Family Relations Act applied, the matrimonial property regime was mandatory. The spouses did not have autonomy with regard to their property relations. Prior to the adoption of the Family Code, theory pointed to the shortcomings of the obligatory property regime, which was no longer appropriate in the light of the changing society and the different conception of property in the Constitution of the Republic of Slovenia. When the Family Code entered into force in 2019, it allowed spouses to opt out of the statutory property regime and, from then on, to regulate their property relations autonomously by means of a contract on the regulation of property relations (formerly known as a »marriage contract«). The contract on the regulation of property relations must be in the form of a notarial deed. While this entails certain costs, the costs of concluding this type of contract are significantly lower than if no contract is concluded and the property is divided on divorce by judicial intervention. Such contracts, which are new in Slovenia, are not new on a global scale, as they have been in use for a long time in many countries of continental Europe, but their cradle is the United States of America. The aim of the Master's thesis is to learn about the effectiveness of the changes in the matrimonial property law brought about by the Family Code and to find out how the changes have been received among theoreticians and in practice. We want to show the new possibilities offered by Slovenian law in the area of property law to spouses both during the duration of the marriage and in the event of its dissolution.
