Title:Izvršitev sodne odločbe o stikih med staršem in otrokom : magistrsko delo

Abstract:Ko med staršema razpade zunajzakonska ali zakonska zveza, morata starša urediti vprašanja glede varstva koristi otroka in torej določiti, komu se bo otrok zaupal v varstvo in vzgojo, določiti morata tudi stike z otrokom ter višino preživnine. Stiki otroka s staršema so izjemnega pomena za celosten razvoj otroka, saj zagotavljajo, da otrok ohrani občutek čustvene povezanosti in pripadnosti s staršem, s katerim ne živi in se z njimi zagotavljajo otrokove koristi, ki jo Družinski zakonik določa kot načelo. Pravica do stikov kot osebnostna in starševska pravica je urejena na ustavni ravni, podrobneje pa jo ureja temeljni zakon na področju družinskega prava – Družinski zakonik. Pravica do stikov je široko urejena tudi na mednarodnem področju, s pravnimi viri kot so Evropska Konvencija o človekovih pravicah, Konvencijo o otrokovih pravicah ter Konvencijo Sveta o otrokovih stikih in poudarjena skozi sodno prakso Evropskega sodišča za človekove pravice. Po sodni ureditvi stikov med staršem in otrokom, v praksi večkrat prihaja do primerov, ko se staršu, ki ima določene stike z otrokom, le-ti neupravičeno preprečujejo in onemogočajo. Otrok lahko začne pod bremenom pritiskov, manipulacij in drugih neprimernih ravnanj starša s katerim živi, hitro zavračati stike z drugim staršem, kar v določenih primerih označujemo kot starševsko odtujevanje. V kolikor se stiki med staršem in otrokom ne izvajajo, ali se jih preprečuje, mora v takšnih primerih v družino poseči država. Varovanje koristi otroka in upoštevanje njegovih največjih potreb in želj je tako za sodišče kot druge strokovne institucije, ki sodelujejo pri razveznem postopku, glavno vodilo. Ko so stiki med staršem in otrokom že sodno urejeni in določeni z izvršljivo sodno odločbo, ki izhaja iz družinskopravnega postopka, pravo posamezniku nudi varstvo na različnih področjih, in sicer primarno na področju družinskega prava, nato pa tudi na področju izvršilnega prava, kazenskega prava in civilnega prava. Magistrska naloga se ukvarja z ureditvijo materialnih in procesnih pravil, ki so na voljo za izvršitev sodne odločbe o stiki med staršem in otrokom.

Title:Enforcement of a court decision on contact between parent and child
Abstract:When a relationship between parents breaks down, they have to determine child-related issues, i.e. who of parents is going to be entrusted with the child's care and upbringing, contact with the child and the amount of maintenance. Contact between a child and his or her parents is important for the child's overall development and ensuring that the child retains a sense of emotional connection and belonging to the parent with whom he or she does not live and safeguarding the child's best interests, a principle laid down in the Family Code. The right of access as a personal and parental right is regulated at constitutional level, but is regulated in more detail by the fundamental law in the field of family law - the Family Code. The right of access is also widely regulated in the international sphere, through legal sources such as the European Convention on Human Rights, the Convention on the Rights of the Child and the Council Convention on Contact between Children, and underlined through the case law of the European Court of Human Rights. In practice, once contact between parent and child has been regulated by the court, there are many cases where the parent who has determined contacts with the child is unjustifiably prevented and prevented from having them. The child may quickly begin to refuse contact with the other parent under the pressure, manipulation and other inappropriate behaviour of the parent with whom he or she lives, which in some cases is referred to as parental alienation syndrome. If contact between parent and child is not maintained or is prevented, the State must intervene in the family in such cases. Protecting the best interests of the child and taking into account the child's best needs and wishes is the guiding principle for the court and also for the other professional institutions involved in the divorce process. Once contact between parent and child has been established by a court order and determined by an enforceable decision resulting from family law proceedings, the law offers protection to the individual in various areas, primarily in the field of family law, but also in the fields of enforcement law, criminal law and civil law. The master's thesis deals with the regulation of the substantive and procedural rules available for the enforcement of a court decision on contact between a parent and a child.
