Abstract:Prepričanje, da obstaja zamejen krog pravnih pravil, ki zanesljivo in popolno regulirajo področje informacijske varnosti, je huda zmota. Na tem področju se vrstijo in medsebojno prepletajo najrazličnejši družbeni podsistemi, ki jih je potrebno upoštevati. Hiter razvoj informacijsko-komunikacijskih tehnologij in z njimi povezanih sistemov, s seboj prinaša tudi kar nekaj težav ter vseskozi odpira nove pravne dileme. Živimo v družbi, ki je praktično odvisna od tehnologije. Pravo pa tehnološkemu razvoju težko sledi. Razloga za to sta vsaj dva. Prvi je togost nekaterih klasičnih pravnih institutov in posledična neuporabnost za nove izzive, ki jih prinaša digitalizacija. Drugi problem je, da bi nenehno spreminjanje pravnih pravil ogrozilo pravno varnost. V magistrskem delu je tako na kratko predstavljeno področje informacijske varnosti, s poudarkom na razlogih za reguliranje tega področja. Predstavljeni so nekateri splošni pravni akti Republike Slovenije in relevantni predpisi Evropske unije. Razvoj tehnologij, kot so umetna inteligenca, internet stvari, robotika in druge informacijsko-komunikacijske tehnologije eksponentno napreduje, kar bo v prihodnosti predstavljajo vedno večji izziv.

Title:Legal aspects of information security
Abstract:Belief that there is a limited set of legal rules that reliably and completely regulate the field of information security is a serious misconception. There is a wide variety of societal subsystems in this area that need to be taken into account. The rapid development of information and communication technologies and related systems also brings a number of problems and constantly raises new legal dilemmas. We live in a society that is practically dependent on technology. The law, however, finds it difficult to keep pace with technological developments. There are at least two reasons for this. The first is the rigidity of some classical legal institutes and their inapplicability to the new challenges brought on by digitalisation. The second problem is that constantly changing legal rules would undermine legal certainty. The Master's thesis thus briefly introduces the field of information security, focusing on the reasons for regulating this area. Some of the general legal provisions of the Republic of Slovenia and the relevant European Union provisions are presented. The development of technologies, such as artificial intelligence, the Internet of Things, robotics and other information and communication technologies is advancing exponentially and will be increasingly challenging in the future.
