Title:Pregledni in predvidljivi delovni pogoji z vidika veljavne zakonodaje in direktive EU 2019/1152 : magistrsko delo

Abstract:Hiter razvoj tehnologije, digitalizacija, novi načini organizacije dela, demografske spremembe ter gospodarska in finančna kriza so prispevale k spremembam delovnega okolja. Slednje je dodatno povečalo potrebo po preglednih in predvidljivih delovnih pogojih, ki zajemajo obsežen spekter vidikov, vključno z delovnim časom, odmori, fizičnimi in psihičnimi zahtevami na delovnem mestu, organizacijo dela, delovnimi aktivnostmi, delovnim okoljem, usposabljanjem, pogoji zaposlitve ter ravnovesjem med poklicnim in zasebnim življenjem. V mednarodni in evropski ureditvi urejajo delavne pogoje predvsem konvencije in priporočila MOD, MPESKP, SDČP, ESL, MESL, Listina EU, direktive in sodna praksa SEU. V Republiki Sloveniji pa so delovni pogoji podrobno urejeni v ZDR-1 in ZVZD-1. V magistrskem delu so obravnavani pregledni in predvidljivi delovni pogoji, ki so jasni in razumljivi, kar omogoča delavcem jasno razumevanje njihovega dela, odgovornosti, pravic, obveznosti in pričakovanj. Takšni delovni pogoji so bistvenega pomena za zagotavljanje visoke ravni zaposlovanja in socialne zaščite, zato njihovo izboljšanje predstavlja eno ključnih prioritet EU. Tako sta Evropski parlament in Svet 20. junija 2019 sprejela Direktivo 2019/1152 o preglednih in predvidljivih delovnih pogojev, ki je nasledila Direktivo 91/533/EGS z dne 14. oktobra 1991 o obveznosti delodajalca, da zaposlene obvesti o pogojih, ki se nanašajo na pogodbo o zaposlitvi ali delovno razmerje. Direktiva 91/533/EGS je določala elemente delovnega razmerja, ki morajo biti delavcem pisno sporočeni, z namenom zagotavljanja ustrezne obveščenost ter zagotavljanja večje varstvo. Analiza uresničevanja Direktive 91/533/EGS je sčasoma pokazala, da le-ta ni več celovito ustrezna, saj ne zagotavlja zadostnega varstva za vse delavce, zato jo je nadomestila Direktiva o preglednih in predvidljivih delovnih pogojih, ki prinaša številne spremembe povezane z delovnimi pogoji, krepi preglednost in predvidljivost delovnih razmerij ter zagotavlja obsežnejše in posodobljene pravice za vse delavce v EU, vključno s tistimi v nestandardnih in novih oblikah dela, ki so bili doslej pogosto izključeni. Hkrati ohranja prožnost za prilagajanje spreminjajočemu se trgu dela. Državam članicam EU se je 1. avgusta 2022 iztekel rok za sprejem predpisov za prilagoditev nacionalne zakonodaje direktivi. Kljub temu, da slednje Republiki Sloveniji ni uspelo v predpisanem roku, je Državni zbor Republike Slovenije na seji 7. novembra 2023 sprejel Zakon o spremembah in dopolnitvah ZDR-1 (ZDR-1D) z vključitvijo določb iz Direktive o preglednih in predvidljivih delovnih pogojih. Slednjega je predsednica Republike Slovenije razglasila 15. novembra 2023.

Title:Transparent and predictable working conditions based on the applicable legislation and Directive EU 2019/1152
Abstract:The rapid development of technology, digitalization, new forms of work organization, demographic changes, and economic and financial crises have led to changes in the working environment. These developments have further increased the need for transparent and predictable working conditions, encompassing a wide range of aspects, including working hours, breaks, physical and psychological demands in the workplace, work organization, work activities, working environment, training, employment conditions, and the balance between professional and personal life. In the International and European regulatory frameworks, working conditions are primarily governed by conventions and recommendations of the International Labour Organization, the Covenant on Economic, Social, and Cultural Rights, the European Social Charter, the Charter of the European Union, Directives, and the Case Law of the Court of Justice of the European Union. In the Republic of Slovenia, working conditions are comprehensively regulated in the Employment Relationships Act and the Safety and Health at Work Act. This master's thesis focuses on transparent and predictable working conditions, which are clear, understandable, and predictable. Such working conditions are of paramount importance for ensuring a high level of employment and social protection, making their improvement one of the key priorities of the European Union. In this regard, the European Parliament and the Council adopted Directive 2019/1152 on transparent and predictable working conditions on June 20, 2019. It has replaced Directive 91/533/EEC from October 14, 1991, which required employers to inform employees about the terms and conditions of their employment or employment relationship in writing. Directive 91/533/EEC stipulated the elements of an employment relationship that must be communicated to employees in writing, with the aim of ensuring adequate information and greater protection. Over time, an analysis of the implementation of Directive 91/533/EEC revealed that it was no longer comprehensive enough to provide sufficient protection for all workers. Consequently, it was replaced by Directive on transparent and predictable working conditions, which introduces numerous changes related to working conditions. It enhances transparency and predictability of employment relationships within the EU and provides more extensive and updated rights for all workers in the EU, including those in non-standard and emerging forms of work, who were often excluded in the past. Simultaneously, the new directive maintains flexibility to adapt to the evolving labor market. Although the EU Member States were required to adopt regulations to align their national legislation with the new directive by August 1, 2022, Slovenia did not manage to meet this deadline. However, on November 7, 2023, the members of the Slovenian Parliament passed the Law on Amendments and Supplements to the Employment Relationships Act, incorporating the provisions of the Directive on transparent and predictable working conditions.
