Abstract:
Novela SPZ-B je leta 2020 v slovenski pravni red uvedla nov institut imenovan povezane nepremičnine. Novost omogoča povezavo stavbnih pravic ali lastninskih pravic na glavnih nepremičninah s stavbnimi ali lastninskimi pravicami na pomožnih nepremičninah, kadar med nepremičninami obstaja funkcionalna povezava – to pomeni, kadar je pomožna nepremičnina trajno potrebna za redno rabo ene ali več glavnih nepremičnin. Povezava nastane tako, da se stavbna pravica ali lastninska pravica na pomožni nepremičnini vključi v samostojno stavbno ali lastninsko pravico na drugi, glavni nepremičnini. Gre za vključeno lastninsko pravico oz. stavbno pravico. Institut povezanih nepremičnin gradi na konceptu vključenih pravic, katerih poglavitni značilnosti sta njihova nesamostojnost oz. akcesornost ter dejstvo, da učinkujejo v korist vsakokratnega lastnika. Vključene pravice niso novost v slovenskem pravnem redu. Primeri vključenih pravic so npr. prava stvarna služnost in nepravo stvarno breme. Vključeno lastninsko pravico pa smo, med drugim, poznali že pri etažni lastnini, kjer se lastninska pravica na splošnih in posebnih skupnih delih vključi v samostojno lastninsko na posameznih delih. Instituta etažne lastnine in povezanih nepremičnin sta si v tem pogledu zelo podobni, zato ureditev povezanih nepremičnin glede številnih vprašanj napotuje na uporabo določb o etažni lastnini. Instituta etažne lastnine in povezanih nepremičnin sta si podobni tudi v tem, da gre večinoma za večosebna razmerja. Povezane nepremičnine so v glavnem namenjen položajem, ko je pomožna nepremičnina potrebna za rabo več glavnih nepremičnin, zato bo pomožna nepremičnina pogosto v solastnini lastnikov dveh ali več glavnih nepremičnin. Seveda pa institut ni omejen zgolj na takšne položaje. Ureditev povezanih nepremičnin je bila deležna kritik zaradi nedoslednosti, ki jih vsebuje. Pravna stroka je na te nedoslednosti opozarjala v postopku sprejemanja novele SPZ-B, vendar zaman. To sicer ne pomeni, da je institut popolnoma neizvedljiv, a je treba pri določenih vprašanjih uporabiti primerno in previdno razlago ter argumentacijo, da pridemo do pravilne uporabe instituta. Institut je nov in zanimivo bo spremljati potek instituta in situacije, v katerih se bo praksa poslužila zadevnega instituta.

Title:
Connected real estates
Abstract:
In 2020, the amendment to the SPZ-B introduced a new institute into the Slovenian legal order called connected real estates. The amendment allows for the linking of building or ownership rights on the main real estate with building or ownership rights on auxiliary real estate where there is a functional link between the real estates - i.e. where the auxiliary real estate is permanently required for the regular use of one or more main real estates. The link is created by the incorporation of a building right or a right of ownership in the auxiliary real estate into an independent building right or right of ownership on another, main real estate. It is an incorporated property right or building right. The institution of connected real estate is based on the concept of incorporated rights, the main characteristics of which are their accessory nature and the fact that they are effective for the benefit of the respective owner of the main real estate. Incorporated rights are not new in the Slovenian legal order. Examples of incorporated rights are, for example, a real easement and a real burden. We have also already been familiar with the incorporation of a right of ownership, inter alia, in commonhold, where the right of ownership on the general and special common parts is incorporated into the independent right of ownership in the individual parts. The institutions of commonhold and connected real estates are very similar in this respect, and the connected real estate regime therefore refers to the application of the provisions on commonhold on a number of issues. The institutions of commonhold and connected real estates are also similar in that they are mostly multi-person relationships. Connected real estates are mainly intended for situations where an auxiliary real estate is necessary for the use of several main real estates, so that the auxiliary real estate will often be co-owned by the owners of two or more main real estates. Of course, the institution is not limited to such situations. The regime of connected real estates has been criticized for the inconsistencies it contains. The legal experts pointed out these inconsistencies during the process of adopting the amendment SPZ-B, but to no avail. While this does not mean that the institute of connected real estates is completely inapplicable and impractical, it is necessary to apply appropriate and careful interpretation and reasoning to certain issues in order to arrive at the correct application of the institute. The institute is new and it will be interesting to see how it develops and the situations in which practice will make use of the institute.
