Title:Analiza predkazenskega in kazenskega postopka ob sumu mučenja živali : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Ljudje in živali spadamo v skupino vretenčarjev, ki imajo med drugim zelo podoben mehanizem zaznavanja bolečine, zato je primerjava percepcije bolečine pri živalih in ljudeh upravičena. Povzročanje nepotrebne bolečine, torej tiste, ki ne nastane med veterinarskimi posegi oz. tistimi, ki so nujni ali koristni za žival, in s tem trpljenja, je praviloma povezno z mučenjem živali. To vključuje številna različna človekova zavržna dejanja do živali, kot so zanemarjanje, draženje, trpinčenje in povzročanje različnih poškodb z različnimi predmeti ali snovmi. Prav tako med mučenje živali uvrščamo živalske borbe, kopičenje živali ter tudi neprimerno in nepotrebno usmrtitev živali. Mučenju živali so lahko izpostavljene vse živalske vrste, poleg domačih tudi prostoživeče živali in tiste v živalskih vrtovih. Namen pričujočega zaključnega dela je bil analizirati postopek policijske obravnave kaznivih dejanj mučenja živali v predkazenskem in kazenskem postopku ter identificirati porajajoče se (sistemske) težave in oblikovati predloge rešitev. Opravljena študija je obsegala pregled statističnih podatkov, študiji dveh primerov iz prakse in intervjuje z višjo kriminalistično inšpektorico, vrhovnim državnim tožilcem, veterinarskim patologom in s sodnim izvedencem. Rezultati so pokazali, da gre pri mučenju živali za hudo obliko ekološke kriminalitete, ki od policistov, tožilcev, veterinarjev in veterinarskih patologov zahteva temeljito obravnavo primera in pogosto tudi hitre odločitve, saj lahko le tako ustrezno in primerno zavarujejo dokaze, ki so v teh primerih ranjene oz. poškodovane živali ali živalska trupla. Pomembno je, da se ustrezno usposobi vse deležnike ter okrepi sodelovanje med policisti, tožilci in veterinarsko stroko oz. da se to sodelovanje protokolarno implementira v obravnavo vsakega primera mučenja živali, saj bi lahko le tako zagotovili ustrezno in strokovno obravnavo vsakega primera mučenja živali. Zapomnimo si že enkrat, da živali niso stvari (niti socialno niti formalnopravno), temveč živa bitja, ki čutijo enako kot ljudje in imajo vso pravico biti in živeti, sobivati z ljudmi.

Title:Analysis of pre-criminal and criminal procedure for suspected animal torture
Abstract:Humans and animals belong to the group of vertebrates, which, among other things, have a very similar pain perception mechanism, so a comparison of the perception of pain in animals and humans is justified. Causing unnecessary pain, i.e., pain that does not occur during veterinary procedures or to those that are necessary or useful for the animal, and thus suffering, is generally connected with animal torture. This includes many human acts of abuse towards animals, such as neglect, teasing, mistreatment, and causing various injuries with various objects or substances. Animal fighting, animal hoarding, and the inappropriate and unnecessary killing of animals are also classified as animal torture. All animal species can be exposed to animal torture, in addition to domestic animals, wild animals, and those in zoos. The purpose of the present final work was to analyse the procedure of police treatment of criminal acts of animal cruelty in pre-trial and criminal proceedings and to identify emerging (systemic) problems and formulate proposals for solutions. The study consisted of a review of statistical data, studies of two cases from practice, and interviews with a senior criminal inspector, the supreme state prosecutor, a veterinary pathologist, and a court expert. The results showed that animal torture is a serious form of ecological crime, which requires police officers, prosecutors, veterinarians, and veterinary pathologists to consider the case thoroughly and often make quick decisions, as this is the only way they can properly and adequately secure the evidence that is in these cases wounded or injured animals or animal carcasses. It is important to adequately train all stakeholders and strengthen cooperation between police officers, prosecutors, and the veterinary profession, or to implement this cooperation as a protocol in the treatment of every case of animal cruelty, as this is the only way to ensure appropriate and professional treatment of every case of animal cruelty. Let us remember once again that animals are not things (neither socially nor formally legally), but living beings that feel the same as humans and have every right to be and live, to coexist with us humans.
