Title:Pristojnosti evropske unije za sprejem pravnih predpisov na področju medijske svobode : magistrsko delo

Abstract:Medijska svoboda kot del pravice do svobode izražanja ima pomembno vlogo v demokratičnih družbah, kakršne so EU in njene države članice. Pomembnost ustrezne ureditve zadevnega področja je v današnjem času vse večja, kar so prepoznali tudi glavni akterji politike EU. Glavno vprašanje, ki ga obravnava magistrska naloga, je, ali in v kakšnem obsegu ima EU pristojnosti za sprejem predpisov na področju medijske svobode. Pregled določb Pogodb hitro pokaže, da EU nima izrecnih pristojnosti na področju svobode medijev. Kljub temu je zaradi kompleksne narave medijev in njihovega stika z različnimi področji prava EU ter skladno z načelom implicitnih (domnevanih) pristojnosti mogoče pristojnosti EU na tem področju črpati iz določb Pogodb o prostem pretoku blaga in storitev, svobodi ustanavljanja, državljanstvu EU, volilni pravici, konkurenčnem pravu in državnih pomočeh ter izobraževanju in kulturi. Obravnavane pravne podlage za sprejem predpisov so v magistrski nalogi konkretizirane s pregledom obstoječe medijske zakonodaje EU in predloga Evropskega akta o svobodi medijev ter pravnih podlag za njihovo sprejetje. Poudarek v magistrski nalogi ni le na pristojnost EU pri zagotavljanju in varovanju medijske svobode, temveč tudi v primeru njenega omejevanja. V določenih primerih lahko pretirana svoboda medijev pomeni kršitev temeljnih pravic in svoboščin drugih. Podlaga za omejevanje svobode medijev s strani institucij EU so pravila o skupni zunanji in varnostni politiki EU, kar je v zaključnem delu konkretizirano z analizo konkretnega primera, odmevne sodbe Splošnega sodišča v zadevi RT France. Zaključno delo se naposled dotakne možnosti širitve pristojnosti EU na področju medijske svobode in pluralizma v prihodnosti.

Title:European union competences for adopting legislation in the field of media freedom
Abstract:Media freedom, as part of the right to freedom of expression, has an important role in democratic societies such as the EU and its Member States. The importance of proper regulation in this field is increasing nowadays, which has also been recognized by the main actors of EU politics. The main question addressed by the thesis is whether and to what extent is the EU competent to regulate media freedom. The Treaties' provisions reveal that the EU does not have any explicit competencies in the aforesaid field. However, attributable to the complex nature of the media and their contact with various areas of EU law, and as for the principle of implicit (presumed) competencies, EU competencies in this field can be derived from the Treaties' provisions on the free movement of goods and services, freedom of establishment, EU citizenship, the right to vote, competition law, state aid, education, and culture. The discussed legal bases are concretized by examining the existing EU media legislation and the proposal for the European Media Freedom Act, as well as the legal bases for their adoption. The thesis emphasizes not only the EU's competencies in ensuring and protecting media freedom but also its restrictions, as excessive freedom of the media may constitute a violation of the fundamental rights and freedoms of others. The basis for the restriction of media freedom by the EU institutions is the rules on the Common Foreign and Security Policy of the EU. Said rules are addressed through a specific case, the high-profile judgment of the General Court in the case of RT France. Finally, the thesis discusses the possibility of expanding EU competencies in the field of media freedom and pluralism in the future.
