Title:Kriminalistični vidiki odkrivanja in dokazovanja prepovedanega prehajanja meje ali ozemlja države : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:V diplomskem delu so predstavljeni postopki kriminalistične policije, ki se nanašajo na obravnavo suma kaznivih dejanj, povezanih z nedovoljenim prehajanjem meje ali ozemlja države Republike Slovenije. S pomočjo statističnih kazalcev je prikazan porast zaznanih ilegalnih migracij v obdobju od leta 2016 do leta 2019 na slovensko-hrvaški meji in porast zaznanih kaznivih dejanj na področju tihotapstva ljudi v tem obdobju. Opisana je sprememba kazenske zakonodaje na tem področju, ko je želel zakonodajalec z višanjem zapornih kazni ustaviti trend naraščanja tovrstnih kaznivih dejanj. Za bolj plastično predstavo je podan opis izmišljenega primera, ko policisti med opravljanjem nalog javne varnosti ob državni meji z Republiko Hrvaško zaznajo sum kaznivega dejanja prepovedanega prehajanje meje ali ozemlja države. Za zaznano kaznivo dejanje je opisan predkazenski postopek, omejitve in težave preiskovalcev ter sodelovanje z okrožnim državnim tožilstvom. Opravljen je bil intervju z višjim državnim tožilcem, ki je opisal izzive tožilstva pri dokazovanja tega kaznivega dejanja na sodišču. Ocena tožilstva je, da je sodelovanje tožilstva in policije na tem področju dobro in da ni potrebe po spremembi veljavne zakonodaje. Po naši oceni ima večina obravnavanih kaznivih dejanj iz področja prepovedanega prehajanje meje ali ozemlja države značilnosti, ki jih uvrščajo med organizirano mednarodno kriminaliteto. Zato je pri preiskavi tovrstnih kaznivih dejanj še toliko bolj pomembno usklajeno mednarodno policijsko sodelovanje.

Title:Criminal investigation aspect of detecting and proving the prohibited crossing of a state border or territory
Abstract:The thesis presents the procedures of the criminal police, which relate to the handling of suspected criminal acts related to unauthorized crossing of the border or territory of the Republic of Slovenia. With the help of statistical indicators, the increase in detected illegal migration in the period from 2016 to 2019 on the Slovenian-Croatian border and the increase in detected crimes in the field of people smuggling during this period are shown. The change in criminal legislation in this area is described, where the legislator wanted to stop the growing trend of such crimes by increasing prison sentences. For a more flexible presentation, a description of a fictional case is given, when police officers, while performing public security duties at the state border with the Republic of Croatia, detect a suspicion of a criminal act of prohibited crossing of the border or the territory of the state. The pre-trial procedure, limitations and problems of investigators and cooperation with the district attorney's office are described for the detected crime. An interview was conducted with a senior state prosecutor who described the prosecution's challenges in proving this crime in court. The prosecution's assessment is that the cooperation between the prosecution and the police in this area is good and that there is no need to change the current legislation. In our opinion, most of the considered criminal acts in the area of prohibited crossing of the border or territory of the country have characteristics that classify them as organized international crime. That is why coordinated international police cooperation is even more important when investigating such crimes.
