Abstract:Zaposleni v gostinski panogi so osrednjega pomena za izkušnje gostov. V gostinstvu je priporočljiv model, po katerem gostinska organizacija svoje dejavnosti – da bi zgradila zvestobo in zadovoljstvo gostov oziroma obiskovalcev – strukturira glede na prednost transakcije gostitelja in gosta, Po takšni strukturi je uspeh gostinskih organizacij in storitev na prvem mestu odvisen od uspešnosti zaposlenih. Zadovoljstvo svojih zaposlenih, zlasti v storitvenih panogah, kot je gostinstvo, je ena prednostnih nalog delodajalcev. Zato je pomembno razumeti vse vidike vloge zaposlenih, ki prispevajo k izboljšanju delovne uspešnosti kot tudi h krepitvi konkurenčne prednosti gostinskega obrata. Čeprav so zaposleni sila dragoceni pri ohranjanju kakovosti storitve, delodajalci v njihovih pogodbah zlorabljajo in kršijo pravice iz Zakona o delovnih razmerjih. Gostinstvo je zelo obsežna panoga, tako po številu obratov kot tudi po številu zaposlenih, zato jih pristojni organi teže nadzorujejo in odpravljajo nepravilnosti. Nezmožnost nadzora nad vsem izkoristijo nekateri lastniki gostinskih obratov. Namen magistrskega dela je ugotoviti, ali se v gostinskih obratih dogajajo zakonske nepravilnosti delodajalcev do svojih zaposlenih. Opravili smo empirično raziskavo med zaposlenimi posamezniki, ki se je nanašala na njihovo zaposlitev v gostinski dejavnosti. Raziskava je obsegala tudi posameznike, zaposlene v negostinskih panogah. Posameznike smo razdelili v dve skupini in jih med seboj analizirali. Zanimalo nas je, ali med skupinama obstajajo statistično značilne razlike v številu mesečno opravljenih urah, koriščenju 30-minutnega odmora za malico in regresu. Na podlagi rezultatov raziskave smo ugotovili, da obstajajo razlike med skupinama, zato sklepamo, da imajo zaposleni v gostinski panogi slabše pogoje v službi, kot zaposleni v negostinski dejavnosti. Delodajalci v gostinski dejavnosti kršijo zakonska določila v večji meri kot pa delodajalci v preostalih panogah.

Title:Legal irregularities of employers to their employees in the hospitality industry
Abstract:Employed individuals in the hospitality industry are central to the guest experience in the hospitality industry. A model is recommended according to which the catering organization structures its activities according to the priority of the host-guest transaction in order to build loyalty and satisfaction of guests or visitors. According to such a model structure, the success of hospitality organizations as well as services depends on the performance of their employees in the first place. Satisfaction of its employees, especially in hospitality industry, is one of the main tasks of employers. It is therefore important to understand the aspects of the role of employees that contribute to improving work performance as well as to strengthening the competitive advantage of the hospitality establishment. However, no matter how important the staff is in maintaining the quality of service, there are abuses and breaches of employment within their contracts. Hospitality is a very large industry, both in terms of number of establishments and employees, so the competent authorities cannot do everything they can to prevent such irregularities, which allows some restaurant owners to use the system to their advantage. The purpose of the master's thesis is to determine whether there are legal irregularities of employers towards their employees working in this industry. For this purpose, we conducted an empirical survey among employed individuals, which related to their employment in catering establishments. The survey also included individuals employed outside the hospitality industry. Individuals were separated into two groups and analysed. We were interested in whether there were statistically significant differences between two groups in monthly hours worked, the use of a 30-minute break, and recourse. We found from the research that there are differences between the two groups, so we conclude that employees in the hospitality industry are worse off or have worse working conditions, and employers respect their contracts less than those employees who work outside the hospitality industry.
