Title:Obravnava mladoletnih prestopnikov na Finskem : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:Stopnja zapiranja na Finskem je bila dolga leta višja kot v sosednjih skandinavskih državah (t.j., Švedska, Norveška, Danska, Islandija). V teh državah je prevladoval sistem »države blaginje«, ki ni zagotavljal le visoke stopnje socialne varnosti vsem državljanom, temveč je vplival tudi na permisivnost v kaznovanju, ki se je odražala v najnižjih stopnjah zapiranja v Evropi. V diplomskem delu se osredotočamo na obravnavo mladoletnih prestopnikov na Finskem. Mladoletniki so v fazi odraščanja, v kateri posamezniki najpogosteje začenjajo s kriminalnimi karierami. Posledično je pomembno, da mladoletnike kaznujemo na način, ki preprečuje nadaljnjo kriminalnost in omogoča uspešno resocializacijo. Med mladoletniki na Finskem prevladuje premoženjska kriminaliteta in kriminaliteta, povezana s prepovedanimi drogami. Poglobljen pregled literature je pokazal, da je deviantnih vse manj mladoletnikov, hkrati pa so deviantni mladoletniki odgovorni za vse več kaznivih dejanj. Finska je s specifičnimi ukrepi v celotnem kazenskem pravosodju zmanjšala stopnje zapiranja odraslih prestopnikov kot tudi mladoletnikov in se pridružila družini skandinavskih držav, za katere so značilne nizke stopnje zapiranja in permisivno kaznovanje. Zaporne kazni za mladoletnike so v večji meri nadomestili v skupnost usmerjene kazenske sankcije. Kljub učinkovitosti tovrstnih sankcij pa se pojavlja problem problematičnih mladoletnikov – povratnikov, saj v skupnost usmerjene kazenske sankcije nanje nimajo učinka.

Title:Treatment of juvenile offenders in finland
Abstract:The imprisonment rate in Finland has been traditionally higher for many years than in neighbouring Scandinavian countries (e.g., Sweden, Norway, Denmark, Iceland). In these countries, the “welfare state” system prevailed, which provided a high level of social security to all citizens and influenced the permissiveness of punishment, which was reflected in the lowest levels of imprisonment in Europe. In the thesis, we focus on the treatment of juvenile offenders in Finland. Juveniles are in the phase of growing up, in which individuals most often start criminal careers. Consequently, sanctions imposed upon juveniles must prevent further criminal activity and enable successful resocialization. Property crimes and drug-related crimes are the most common form of juvenile crime in Finland. An in-depth review of literature has shown that the number of juvenile delinquents has decreased, however, these juveniles are responsible for more and more crimes. With specific measures throughout the criminal justice system, Finland has reduced the imprisonment rates of adult offenders as well as juveniles and joined the family of Scandinavian countries, for which low prison rates and permissive punishment are characteristic. The use of alternative community-based sanctions largely replaced imprisonment as a form of sentence for juveniles. Despite the effectiveness of such sanctions, there is a problem of problematic juveniles – recidivists, as community–based sanctions have no effect on them.
