Title:Poznavanje pravic študentov FOV UM, ki jih imajo pri opravljanju dela preko študentskega servisa

Abstract:V magistrskem delu smo obravnavali študentsko delo. Opazovana skupina so bili dodiplomski in podiplomski študentje FOV UM Kranj, ki so bili na fakulteto vpisani v študijskem letu 2020/2021. V empiričnem delu smo uporabili metodo raziskovalnega dela spraševanje z anketiranjem. Pri tem smo uporabili orodje za anketiranje 1ka. V teoretičnem delu smo uporabili deskriptivno metodo dela. Namen izdelave magistrskega dela je bil ugotoviti, v kolikšni meri študentje poznajo svoje pravice, ki jih imajo z delom prek študentskega servisa, in v kakšni meri so seznanjeni s tem, kaj vse jim pri opravljanju tovrstne oblike dela zakonsko ne pripada. Delo prek študentskega servisa, imenovano tudi študentsko delo, je edinstveno za Slovenijo, saj tovrstnega dela v enaki pojavni obliki ne poznajo nikjer drugje v Evropski uniji. Še ena zanimivost tovrstne oblike dela je, da posameznik ni neposredno v delovnem razmerju z delodajalcem, temveč so v vlogi posrednika poslovni subjekti, torej koncesionarji, ki jim je bila podeljena pravica za posredovanje študentskega dela, bolj poznani pod imenom študentski servisi. V raziskavi smo ugotovili, da se večji del študentov, to je več kot 50 %, zaveda, da jim pri opravljanju dela prek študentskega servisa ne pripadajo nekatera izplačila, kakršna pripadajo osebam, ki so v rednem delovnem razmerju, na primer nadomestilo za malico in prevoz, plačan dopust in izplačilo regresa. Kljub temu menimo, da je študentsko delo v svoji pojavni obliki smiselno obdržati, saj na ta način mladi posamezniki dobijo priložnost, da se vključijo v delo organizacije, in tako pridobivajo dragocene delovne izkušnje.

Title:Awareness of FOV UM Students about their rights when performing work through student service
Abstract:The topic of this master’s thesis is student work in Slovenia. Student work (in Slovenian: študentsko delo) is special for Slovenia, since this particular type of work is not present anywhere else in the European Union. Another interesting fact about student work is the following: with this type of work, working students are not in a direct legal relationship with the employer, but with the student service (in Slovenian: študentski servis), recognized as a third party, which was given concession to offer student jobs. The observed group comprised students who were enrolled in undergraduate and postgraduate studies at the FOV UM Kranj in the academic years of 2020/2021. The method used for sourcing data in the empirical part was conducting a questionnaire (using the 1ka poll), and in the theoretical part, we used the descriptive method. The purpose of this master’s thesis was to determine to which level students who perform work through the student service are aware of their working rights, to which they are entitled, and to determine what they are not entitled to when performing this type of work. With this type of employment, for example, students who perform student work are, considering the Employment Relationships Act, not entitled to payment for transport to work, lunch, holidays, etc. With this research, we discovered that the majority of students (more than 50%) are mostly aware that, when performing work through the student service, they are not entitled to some payments, to which are entitled the »regular« employees. However, we believe that student work as a type of employment is good, because it gives students and young adults the possibility to get engaged in different organisations and gain valuable work experience.
