Title:Lažna in izsiljena priznanja mladoletnikov : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:Diplomsko delo opisuje pomanjkljivosti zasliševanja, katera se pojavijo pri zasliševanju mladoletnikov. Te poleg oseb s posebnimi potrebami, oseb z nižjo ravnjo inteligence (merjeno po IQ ravni) in oseb z diagnosticiranimi psihosomatskimi motnjami predstavljajo posebej ranljivo populacijo, saj zaradi še svoje ne razvitosti ne znajo oceniti resnosti zaslišanja, ter posledice, ki lahko iz tega nastanejo. Prav tako so v nevarnosti, da same sebe inkriminirajo, zaradi nepoznavanja ali nerazumevanja zakonov in svojih pravic, oziroma še ne dojemajo pravnih posledic, ki lahko nastanejo. Problem nastane v policijskem sistemu, v katerega je vnaprej uvedena neusmiljena taktika zasliševanja, katera je primarno namenjena pridobivanju priznanja in ne iskanju resnice, katera po vsem tem niti ni prilagojena za zaslišanje mladoletnih osumljencev. Pri tem bomo v tej nalogi spoznali tehnike, ki jih policisti uporabljajo za pridobivanje priznanj, katere bomo presodili in evalvirali na podlagi primerov, kjer je bila uporabljena Reidova tehnika. Težava je tudi, da mladoletne osebe velikokrat zavrnejo prisotnost odvetnika, družinskega člana ali prijatelja, saj menijo, da so zaradi svoje neudeleženosti pri povzročitvi kaznivega dejanja varni. Prav pod pritiskom ostrih tehnik zasliševanja hitreje popustijo, saj iščejo hitro olajšanje (da gredo čimprej domov), rečejo kar mislijo da policisti želijo slišati in ker menijo, da bodo priznanje lahko odvzeli in bodo s tem varni pred pregonom. Najpogosteje pa mladoletniki podajo lažno ali izsiljeno priznanje, kadar s tem branijo družinskega člana ali prijatelja.

Title:False and coersed confessions among adolescents
Abstract:My thesis discusses important shortcomings in the interrogation techniques that often occur when interrogating adolescents. They, along with people with special needs, people with lower intelligence (based on the IQ level) and people with diagnosed psychosomatic disorders represent an especially vulnerable population, since because they are (yet) less developed they can't evaluate the serious nature of interrogation as well as the consequences that may follow. They are also in danger of incriminating themselves because their lack of knowledge and understanding of law and their rights as well as the consequences that might befall them. The problem often lies in the police system which involves a merciless technique of interrogation, which purpose is mostly in eliciting a confession instead of the truth and it is mostly not adapted for interrogation of adolescents. In this thesis we will learn about the techniques that police officer use when trying to elicit a confession, mostly based on examples in practice and research that have used and researched the Reid technique. The problem also occurs when adolescents refuse the presence of a lawyer, a family member or a friend during the interrogation process as they think that they are safe because they are innocent. And a lot of them fall under the pressure of intense interrogation techniques as they search for a quick relief (they want to go home as soon as possible) – that is why they say what they think the officers want to hear and think maybe they will be able to withdraw their false confession later. Most often they give a false or a coerced confession because they are trying to protect a family member or a friend.
