Title:Kriminalistični vidiki predkazenskega postopka v primeru zlorabe dovoljenj za prebivanje - združitev družine : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Zaključno delo je predstavljeno iz vidika kriminalističnega odkrivanja in preiskovanja odklonskih dejanj v primerih zlorabe dovoljenj za prebivanje ob združevanju družin. Predstavlja pogoje in pravno podlago pridobitve dovoljenj za prebivanje v sklopu združitve družine, obseg predkazenskega postopka ter pooblastila policije pri odkrivanju in preiskovanju kaznivih dejanj v povezavi z združitvijo družine ter stališče tožilstva in dosedanjo sodno prakso v povezavi z odklonskimi dejanji ob združitvi družine. Za primerjavo zahtevnosti pridobitve dovoljenj za prebivanje na podlagi združitve družine v Republiki Sloveniji smo primerjali tovrstne pogoje pridobitev dovoljenj v drugih evropskih državah. Ugotovili smo, da so policijski predkazenski postopki pri odkrivanju in preiskovanju kaznivih dejanj v povezavi z združitvijo družin zahtevni, ker se v tovrstnih primerih analizira večji obseg dokumentacije in so postopki dolgotrajni. Prav tako smo ugotovili, da Republika Slovenija nima postavljenih visokih pogojev, v kolikor želi tujec združiti manjše število družinskih članov. V primeru, da želi tujec v Republiko Slovenijo preseliti tri ali več družinskih članov, ga lahko glede na njegov prihodek močno ovira pogoj prikazovanja zadostnih sredstev, ravno zaradi katerega prihaja do največjih zlorab oziroma odklonskih dejanj. Kot možnost izboljšave, v povezavi s protipravnimi pridobljenimi dovoljenji za prebivanje ob združevanju družin, smo z raziskavo v diplomskem delu ugotovili, da bi lahko že sama sprememba pogojev prikazovanja zadostnih sredstev, v Pravilniku o načinu ugotavljanja zadostnih sredstev za preživljanje v postopku izdaje dovoljenja za prebivanje, bistveno pripomogla k preprečevanju zlorab na tem področju. S spremembo navedenega pravilnika država ne bi zaostrila pogojev preseljevanja tujcev na podlagi združevanja družine, temveč bi se po vsej verjetnosti zmanjšalo tveganje za storitev odklonskih dejanj, ki nastanejo ob združevanju družin.

Title:Criminal Investigation Aspects of Pre-Trial Proceedings in the Case of Abuse of Residence Permits – Family
Abstract:The final paper is presented from the aspect of the criminal detection and investigation of deviant acts in cases of the abuse of residence permits during family reunifications. It presents the conditions and legal basis for obtaining residence permits as part of family reunification; the scope of pre-trial proceedings; the powers of the police in detecting and investigating crimes related to family reunification; the position of the prosecution; and the case law related to deviant acts during family reunification. To compare the complexity of obtaining residence permits on the basis of family reunification in the Republic of Slovenia, the conditions for obtaining permits were compared with other European countries. It has been found that police pre-trial proceedings in detecting and investigating crimes related to family reunification are demanding because in such cases larger volumes of documentation are analyzed and the proceedings are lengthy. It has also been found that the Republic of Slovenia does not impose strict conditions in cases when a foreigner wants to reunite a smaller number of family members. In the event that the foreigner wants to relocate three or more family members to the Republic of Slovenia, he/she may be severely hampered by the condition of demonstrating sufficient funds, which is the reason for the greatest abuses and deviant acts. A possible improvement in connection with illegally obtained residence permits upon family reunification, as ascertained by conducting research in the context of the final paper, would be to change the conditions for demonstrating sufficient funds in the “Rules on the method of means testing for sufficient funds in the issuing procedures for residence permits”, which could significantly contribute to the prevention of abuses in this area. By amending the above-mentioned rules, the state would not tighten the conditions for the relocation of foreigners on the basis of family reunification, but would probably reduce the risk of committing deviant acts arising from family reunification.
