Title:Vloga izvedenca medicinske stroke v civilnih sodnih postopkih : diplomsko delo

Abstract:Izvedenstvo v civilnih pravdnih postopkih predstavlja vedno bolj pomembno dokazno sredstvo v nenehno razvijajočem pravnem sistemu. Diplomska naloga obravnava in analizira vlogo sodnih izvedencev s poudarkom na problematiki izvedenstva medicinske stroke. Slednjih se v praksi na podlagi kompleksnih dejanskih stanj pojavlja največ, predvsem v odškodninskih sporih in v zvezi z odmero nepremoženjske škode. Sodišče uporabi dokaz z izvedencem takrat, kadar ne razpolaga s strokovnim znanjem. Primarna funkcija izvedenca je izdaja izvida in mnenja na podlagi strokovnega znanja, ki znatno pripomoreta k razjasnitvi relevantnih dejstev. Stranke procesa konkretno opredelijo, o čem naj izvedenec izdela izvid in mnenje, pogosto pa jih pozove tudi sodišče, da postavijo vprašanja, katera se postavijo izvedencu. Z uvedbo novele E Zakona o pravdnem postopku se je izvedenstvo uveljavilo kot samostojni dokaz pred pravdo.

Title:The role of court appointed medical expert in civil court proceedings
Abstract:Expertise in civil litigation is an increasingly important means of evidence in an ever-evolving legal system. The diploma thesis discusses and analyzes the role of forensic experts with an emphasis on the issue of medical expertise. In practice, the latter occur the most based on complex facts, especially in compensation disputes and in connection with the assessment of non-pecuniary damage. The court uses evidence with an expert when it does not have the expertise. The primary function of the expert is to issue a report and opinion based on expertise, which significantly helps to clarify the relevant facts. The parties to the process specify what the expert should report and opinion on, and they are often asked by the court to ask questions to the expert. With the introduction of the amendment E to the Civil Procedure Act, expertise was established as an independent piece of evidence before the court.
