Title:Prevlada drugega javnega interesa po Direktivi o habitatih (člen 6/4) in izpolnjevanje pogojev po Okvirni direktivi o vodah (člen 4/7) : diplomsko delo

Abstract:Država zaradi velike porabe energije načrtuje izgradnjo hidroelektrarn na reki Muri, ki je zadnja prostotekoča reka v Sloveniji, čeprav projekt zadnja leta, zaradi močnih uporov aktivistov, stagnira. Hidroelektrarne bi naj kot drug javni interes nadvladale nad javnim interesom ohranjanja narave po Direktivi o habitatih in bi zato bila mogoča umestitev v zavarovano območje (Natura 2000). V delu sem opisala splošne pogoje in izjeme iz člena 4/7 Okvirne direktive o vodah, ki jih je prav tako potrebno upoštevati pri planiranju objektov. Prav tako sem opisala in primerjala postopek celovite presoje vplivov na okolje in postopek presoje vplivov na okolje ter postopek prevlade drugega javnega interesa nad javnim interesom ohranjanja narave. Diplomsko delo je razdeljeno na štiri poglavja. Prvo poglavje zajema kratek uvod in opis vsebine diplomskega dela. V drugem poglavju je obravnavan pojem prevladujoč javni interes nad javnim interesom ohranjanja narave, vse pa je podkrepljeno s pregledom Direktive o habitatih, predvsem člena 6/4, in prakso Sodišča Evropske unije. V tretjem poglavju so predstavljeni splošni pogoji po Okvirni direktivi o vodah in izjeme od teh pogojev, ki prav tako morajo biti izpolnjeni, če želi investitor projekta uveljaviti prevladujoč javni interes. Četrto poglavje vsebuje podroben opis postopka CPVO in postopka PVO ter postopek prevlade drugega javnega interesa v povezavi z njima.

Title:The prevalence of another public interest under the Habitat directive (article 6/4) and the fulfilment of conditions under the Water framework directive (article 4/7)
Abstract:Due to great energy consumption, the government is planning to build hydroelectric power plants on Mura River, the last free-flowing river in Slovenia. The project has stalled in the last few years due to fierce opposition from environmental activists. Designated as ‘other public interest’, hydroelectric power plants should prevail over public interest in accordance with the Habitats Directive, so positioning in protected area is possible (Natura 2000). My thesis presents general conditions and exceptions pursuant to Article 4/7 of the EU Framework Water Directive that must be considered in planning structures. In addition, the procedures of comprehensive assessment of environmental impact and assessment of environmental impact, as well as the procedure of other public interest prevailing over public interest to preserve the environment are described and compared. The graduation thesis comprises four chapters. The first chapter includes a short introduction and describes the content. The second chapter discusses the concept of public interest prevailing over public interest of nature conservation in view of the Habitats Directive, particularly Article 6/4 and the case law of the Court of Justice of the European Union. The third chapter presents general conditions in accordance with the EU Water Framework Directive and exceptions to the conditions that must be met in order for a developer to claim prevailing public interest. The fourth chapter includes a detailed description of the procedures of comprehensive assessment of environmental impact, assessment of environmental impact and consequently other public interest prevailing.
