Title:Nekatera vprašanja upravnopravnega varstva okolja v Republiki Sloveniji

Abstract:Namen prispevka: Namen prispevka je predstaviti sistem pravnega urejanja varstva okolja v Republiki Sloveniji, njegovo vrednostno izhodišče in temeljna načela ter analizirati različne pristope k upravnopravnemu urejanju varstva okolja. Ta cilj bo dosežen z analizo pozitivno-pravne ureditve varstva okolja in primerjalno analizo stališč teorije. Prispevek izhaja iz klasičnega razumevanja razmerja med državo in posameznikom in ga nadgrajuje s pomočjo spoznanj na področju upravnopravnega urejanja varstva okolja. Glavna ugotovitev prispevka je, da se je na področju varstva okolja v Sloveniji v polni meri uveljavilo načelo odprtosti delovanja uprave, s čimer je okoljsko upravno pravo postalo referenčno področje za uveljavljanje tega načela na drugih področjih upravnega prava. Metode: Prispevek temelji na deskriptivni analizi de lege lata upravnopravne ureditve varstva okolja v Republiki Sloveniji. Poudarek študije je na upravnem pravu, brez implikacij na civilno pravno in kazensko pravno ureditev. Ugotovitve: Slovenska pravna ureditev varstva okolja je razdeljena na dve glavni področji: nadzorovanje onesnaževanja in sanacije ter ohranjanje in upravljanje virov. Pravna ureditev je pogosto vsebinsko omejena – to je, da se pravna določila nanašajo samo na določene elemente okolja, kot so zrak, voda, prst itd – in nadzor tako emisij in onesnaževanja posameznega naravnega vira kot tudi odgovornost za prekoračitev dovoljene emisije in odgovornost za čiščenje in sanacijo. Raziskovalni rezultati v članku so omejeni na primer Slovenije. Izvirnost/pomembnost prispevka: Vrednost naslovnega članka je v analitičnem prikazu podlag in normativne ureditve posebnega upravnopravnega področja, kot je varstvo okolja.

Title:Some questions of administrative legal regulations of environment protection the Republic of Slovenia
Abstract:Purpose: The purpose of this paper is twofold. Firstly, it aims to present the regulation, values, and fundamental principles of environment protection in Slovenia, and, secondly, it analyses various approaches of administrative-legal arrangements of environment protection. The conclusions are based on the analysis of positive law regulating environmental protection, and a comparative overview of the relevant theoretical assumptions. The paper builds on the classical understanding of the relationship between a state and a citizen, and develops the idea further through a presentation of administrative-legal arrangements in the field of environment protection. The main conclusion is that, in Slovenia, the principle of openness (in public administration) has become a well-established practice in the field of environmental protection, thus serving as a good reference example on how to promote openness in other areas of administrative law. Design/Methods/Approach: The article is based on an analysis of legal documents (ecological laws and bylaws) which define organisational and functional aspects of state bodies that should tackle threats to the environment. The article is based on descriptive analysis of the de lege lata legal system of environment protection in the Republic of Slovenia. Findings: Slovenian legal regulation of ecologic threats is divided into two major areas: pollution control and remediation; and resource conservation and management. Legal regulation is often media-limited - i.e., pertain only to a single environmental medium, such as air, water, soil, etc. - and control both emissions of pollutants into the medium, as well as liability for exceeding permitted emissions and responsibility for clean-up. The research results in the article are limited to Slovenian case. Originality/Value: The value of this article is an attempt to identify a consistent Slovenian administrative legal regulation of threats to environment.
