Abstract:Lokalne skupnosti so orodje, ki ga smo si ga ljudje izmislili za lažje zadovoljevanje svojih potreb, saj imajo na različnih območjih različni ljudje tudi različne potrebe. Zato vsaka 4 leta za lastno območje izvolijo svojega predstavnika, ki bo zadovoljeval te potrebe in ravnal v dobro njihove občine. Ta predstavnik je župan, ki predstavlja občino, skrbi za izvajanje njenih finančnih poslov ter njen razvoj. Ima tudi vpliv pri sprejemanju odlokov, lahko pa se zgodi, da naloge z občinske ravni preidejo na državno, in sicer če se država za to odloči in priskrbi potrebna sredstva. Županu je torej dano veliko zaupanje, na žalost pa se to zaupanje dostikrat zlorabi in za preprečevanje takšnih in drugačnih zlorab, smo ljudje ustvarili tudi zakone, ki urejajo med drugim županove pristojnosti, kazniva dejanja, prekrške ter njihove sankcije. Župani morajo odgovarjati za svoja dejanja, v rokah države pa je, da bo to odgovornost uzakonila ter v praksi tudi preverjala, kot se spodobi za pravno državo. Glede na to, da so župani predstavniki in organ občine, morajo v skladu s pomembnostjo svoje funkcije sprejeti tudi odgovornost za svoja dejanja. V primeru, da država ne sankcionira dovolj ali sploh ne sankcionira dejanj, ki so koruptivna, neodgovorna, nepremišljena in naklepno povzročijo škodo občini, se to posledično odraža tudi na višji, torej državni ravni. Dandanes je toliko področij, ki so že urejena ampak veliko je tudi tistih, ki so urejanja še potrebna, še posebej zato, ker Evropska unija množično izdaja uredbe in je težko slediti vsem spremembam in pravzaprav na konkretni ravni vedeti, kaj sploh župan sme in ne sme v okviru zakonov ter uredb. Prekrški so razpršeni po različnih zakonih in uredbah, so tudi nepregledni in precej milostni. Kar pa pomeni odstopanje od načela jasnosti in določnosti predpisov ter slabi zaupanje v državni red.

Title:Misdemeanor liability of the mayor
Abstract:Local communities are a tool that people have invented to help meet their needs, because different people have different needs in different local areas. Therefore, every 4 years they elect a representative who will meet these needs and act for the benefit of their comunity. And this representative is called the mayor. The mayor represents comunity, takes care of their finances and contributes to the city development, he also has an influence in the acceptance of decrees, and sometimes the tasks from the state level are transferred to the local authority, if the state decides so and provides the necessary funds. The mayor is therefore given great trust, but unfortunately this trust is often misused and in the hope of prevention of this misuse, people have created laws that govern mayors competencies, criminal offenses, minor offenses and their sanctions. The mayors must be held accountable for their actions, and it is in the hands of the state that this responsibility will be regulated by law as is appropriate for the lawful state. Considering that the mayors are representatives and state officials, in accordance with the importance of their function, they must take responsibility for their actions. In the event that the state does not sanction enough or at all this leads to acts like: corruption, irresponsible behaviour, recklessnes and deliberate cause of damage to the city.This is consequently also reflected at the higher state level. Nowadays, there are so many areas that are already regulated, but there are also alot of areas that need new regulations, and after all the the European Union regulations, it is difficult to follow all the changes and to know precisely what the mayor may and may not do in the framework of laws. The flaws are scattered over a number of different laws and regulations, and they are not well-regulated and are rather gracious in the sanction area. This is a breach of the principle of clarity and certainty and a breach of regulations that causes weakened confidence in the state order.
