Title:Kriptovalute in njihov kriminalni potencial : diplomsko delo visokošolskega študijskega programa Informacijska varnost

Abstract:V diplomski nalogi so predstavljene kriptovalute, kot posebna oblika digitalnega oziroma virtualnega denarja, ki vse bolj spreminja prihodnost finančnega sveta. Posebna pozornost je namenjena prvi in najbolj popularni decentralizirani kriptovaluti, imenovani Bitcoin. Zaradi lažjega razumevanja nastanka in delovanja sistema kriptovalut, je opravljena podrobnejša analiza njihovih tehničnih karakteristik in ob tem narejena primerjava s klasičnim denarjem. Čeprav so kriptovalute formalno že postale menjalno sredstvo, pa za razliko od »pravih« valut v večini držav še vedno niso strogo zakonsko regulirane, v nekaterih državah pa so celo prepovedane. Ravno pravna (ne)urejenost kriptovalut, omogoča špekulantom in kriminalcem njihovo uporabo za nelegalne ter kriminalne dejavnosti, kot so kraje kriptovalut, pranje denarja, davčne utaje, trgovina z nezakonitim blago, kljub sicer precej varni block chain tehnologiji, na kateri kriptovalute slonijo. Raziskovalni del naloge se osredotoča na rezultate opravljene ankete. Osebe, ki so jo izpolnile so se morale opredeliti glede na vrsto kriptovalute, ki jo uporabljajo in katere dobrine ali storitve so z njo kupili. Rezultati so pokazali, da želja po hitrem in visokem zaslužku, ter zagotovljena večja stopnja anonimnosti prevladujeta pri odločitvi o poslovanju s kriptovalutami, ob čemer uporabniki zanemarijo njihovo pravno ureditev in posledice morebitnih nelegalnih dejanj.

Title:Crypocurrencies and their criminal potencial
Abstract:The diploma thesis presents cryptocurrencies, as a form of digital or rather, virtual money. The currency has had an enormous impact on the financial world. Special attention is paid to the biggest and most popular cryptocurreny named Bitcoin. In order to facilitate the understanding of the origin and operation of the crypto-system, a more detailed analysis of their characteristics is made within the thesis. Allthough cryptocurrencies have already formally become a conversion tool, unlike the ''real'' currencies, in most countries, they are still not strictly regulated by law, and are in some countries even prohibited. Due the lack of legal arrangement of cryptocurrencies, speculators and criminals commonly use them for illegal and criminal activities, such as theft, money laundering, tax evasion and so on. The research part of the thesis focuses on the results of the carried out survey. The people who filled it out had to define themselves according to which kind of cryptocurrencies they use and what kind of goods or services they bought with them. The results showed that the desire for quick and large earnings and a guaranteed degree of anonymity prevail over the decision of trading with cryptocurrencies, whereby users neglect their legal regulation and consequences of possible illegal acts
