Title:Korupcija v šolah vožnje : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Korupcija se dandanes pojavlja v različnih oblikah in razsežnostih, ki segajo od samih vrhov političnih oblasti, do neposrednih uporabnikov storitev državnega aparata. V diplomskem delu je predstavljen pojem korupcije v povezavi s t. i. »sistemsko korupcijo« in korelacijo z izvajanjem dodatnih usposabljanj za voznike začetnike. Odkrite nepravilnosti pri izvajanju usposabljanj so se pojavljale po sprejetju novih načinov izobraževanj v Zakonu o voznikih leta 2010, kar je bilo tudi vodilo pri raziskovanju poteka sprejetja zakonodaje na tem področju, v primerjavi z ureditvami v nekaterih drugih državah Evropske unije. Po opravljenih raziskavah zakonskih ureditev držav in zaključkih pravnomočnih sodb v Republiki Sloveniji, je bilo ugotovljeno, da so bila zakonodajna pravila ob začetku sprejetja nove zakonodaje na področju usposabljanja voznikov pomanjkljiva, kar je omogočalo izkoriščanje sivih polj pri izvajanju nadzora, vendar pa se temeljne oblike izobraževanj voznikov začetnikov bistveno ne razlikujejo od izobraževanja v drugih državah Evropske unije. Naknadni popravki zakonodaje v Republiki Sloveniji so okrepili mehanizme nadzora z namenom preprečevanja izvajanja nepravilnosti. Prav tako je bilo ugotovljeno, da bi bilo za povezavo med sprejetjem zakonodaje v letu 2010 in sistemsko korupcijo, potrebno poglobljeno preiskovanje povezav med pobudniki novih ukrepov in subjekti, ki bi imeli s tem koristi, pri čemer pa so tudi najvišji nadzorni organi nemočni brez ustrezne politične podpore.

Title:Corruption in driving schools
Abstract:Corruption is present in various forms and dimensions. It can be found in the highest political authorities as well as with indirect users of state apparatus services. The term corruption, presented in this thesis, is related to the so-called “systemic corruption” and to correlation with performing extra training courses for novice drivers. Irregularities found when performing training courses appeared after new ways of education were accepted in Drivers Act in 2010, which was the motto of researching the procedure of accepting legislation in this area in comparison with regulation in some other countries of the European Union. After a study of legislation of the countries and after the final judgements in the Republic of Slovenia it was found out that the legislative rules that were accepted in the beginning of accepting the new legislation in the area of training drivers were insufficient. That allowed exploitation of the grey area when performing controls. However, the basic forms of education of novice drivers do not differ significantly from such education in other countries in the European Union. Subsequent adjustments of the legislation in the Republic of Slovenia reinforced supervisory mechanisms to prevent irregularities. It was also found out that a thorough investigation of connections between initiators of new measurements and entities that would profit from that should be carried out to make a connection between acceptance of legislation in 2010 and systemic corruption. But even the most senior representatives of supervisory authority are powerless without adequate political support.
