Title:Mednarodno kazensko sodišče in neodvisna preiskava (študija primerov) : magistrsko delo

Abstract:Mednarodno kazensko sodišče nima lastnih preiskovalcev v smislu naddržavne policije s polnimi pooblastili za preiskavo kaznivih dejanj v svoji pristojnosti. Pri pridobivanju informacij, preiskovanju kaznivih dejanj in pregonu njihovih storilcev je močno odvisno od sodelovanja držav, različnih mednarodnih in nevladnih organizacij in drugih zunanjih virov. S študijo različnih odločitev, ki jih Mednarodno kazensko sodišče sprejema v okviru svojega dela, poskušam ugotoviti, kako ti s svojim sodelovanjem ali nesodelovanjem vplivajo na preiskavo, pregon in nadaljnje odločitve Mednarodnega kazenskega sodišča v kazenskem postopku. Kako njihovo sodelovanje ali nesodelovanje vpliva na delo preiskovalcev Mednarodnega kazenskega sodišča. Kakšne dokaze lahko pridobijo in kako močni so. In vpliv, ki ga imajo različne okoliščine in dejanja preiskovalcev na njihovo dopustnost in dokazno vrednost. Kako Mednarodno kazensko sodišče poskuša zmanjšati njihov vpliv na preiskavo in nadaljnje odločitve in kakšne možnosti ima za uveljavljanje svojih odločitev v praksi. Z nadaljnjo primerjavo s podobnimi primeri in odločitvami iz prakse Evropskega sodišča za človekove pravice ugotavljam, ali imajo ta dejanja in okoliščine v preiskavi podobne posledice za kazenski postopek pred Mednarodnim kazenskim sodiščem, kot bi ga imela, če bi bile njegove odločitve podvržene presoji Evropskega sodišča za človekove pravice. In kako se njihova preiskava ujema z zahtevami za neodvisno preiskavo, ki jih je s svojo prakso določilo Evropsko sodišče za človekove pravice. V zaključku povzamem bistvene ugotovitve in na njihovi podlagi predlagam nekaj rešitev, ki bi lahko povečale možnost izvedbe uspešne neodvisne preiskave kaznivih dejanj v pristojnosti Mednarodnega kazenskega sodišča.

Title:The International Criminal Court and independent investigation (case study)
Abstract:The International Criminal Court does not have its own investigators in terms of supra-national police with full powers to investigate criminal offenses within its jurisdiction. In obtaining information, investigating criminal offenses and prosecuting their perpetrators, it strongly depends on the participation of countries, various international and non-governmental organizations and other external sources. By studying various decisions taken by the International Criminal Court in the course of their work, I am trying to find out how, through their cooperation or non-cooperation, they influence the investigation, prosecution and subsequent decisions of the International Criminal Court in criminal proceedings. How their cooperation or non-cooperation affects the work of the investigators of the International Criminal Court. What evidence can they gain and how strong they are. And the impact that different circumstances and acts of investigators have on their admissibility and evidential value. How does the International Criminal Court attempt to reduce their influence on the investigation and subsequent decisions and what options it has in place to enforce its decisions. By continuing to compare with similar cases and decisions from the practice of the European Court of Human Rights, I determine whether these acts and the circumstances of the investigation have similar consequences for the criminal proceedings before the International Criminal Court, as would have been, if its decisions were subject to the assessment of the European Court of Human Rights. And how their investigation matches the requirements for an independent investigation, which the European Court of Human Rights has established with their practice. In conclusion, I summarize the substantive findings and, on the basis of them, I propose some solutions that could increase the possibility of conducting a successful independent investigation of criminal offenses under the jurisdiction of the International Criminal Court.
