Title:Postopki za reševanje prezadolženosti fizičnih oseb v slovenski in italijanski pravni ureditvi (osebni stečaj in postopki zaradi prezadolženosti)

Abstract:V slovenski pravni ureditvi je osebni stečaj uveden leta 2008 z Zakonom o finančnem poslovanju, postopkih zaradi insolventosti in prisilnem prenehanju. Ta zakon omogoča prezadolženim fizičnim osebam, da pod določenimi pogoji in po točno predpisanem postopku upnikom poskušajo poplačati terjatve iz premoženja, ki je del stečajne mase, za preostanek dolgov, ki niso zmoženi plačati pa lahko zaprosijo v posebnem postopku odpust obveznosti. V italijanskem pravnem sistemu so fizične osebe izključene iz stečajnega zakona, saj so opredeljene kot »soggetti non fallibili« oz. osebe, nad katerimi ni mogoče začeti stečajnega postopka. Iz tega razloga italijanska pravna ureditev ne pozna instituta osebnega stečaja, ampak je leta 2012 uvedela poseben zakon, zunaj stečajnega zakona, ki se imenuje Legge n. 3/2012 in ureja postopke za reševanje prezadolženosti fizičnih oseb. Italijanska zakonodaja omogoča dva postopka finančne reorganizacije, na podlagi katerih se prezadolženi dolžnik skuša dogovoriti o poplačilu svojih dolgov z upniki, tretji postopek pa je podoben našemu institutu osebnega stečaja in predpisuje postopek likvidacije (stečaja) premoženja dolžnika, pod določenimi pogoji tudi odpust obveznosti. Namen diplomske naloge je predstaviti s čim manj teorije postopke za reševanje prezadolženosti fizičnih oseb v slovenski in italijanski pravni ureditvi in predstaviti glavne razlike med dvema ureditvama.

Title:Procedures for addressing overindebitness of natural persons in the Slovenian and Italian legal systems
Abstract:In the Slovenian legal system, civil bankruptcy has been introduced in 2008 with the Financial Operations, Insolvency Proceedings and Compulsory Winding-up Act. It gives overindebted natural persons the option to try to repay the receivables to the creditors under certain conditions and according to an exact prescribed procedure from the property that is a part of the bankruptcy estate, while for the remainder of the debts they are unable to repay, they can apply for a remission of debt in a special procedure. In the Italian legal system, natural persons are excluded from the bankruptcy law since they are defined as »soggetti non fallibili« or persons against which bankruptcy proceedings cannot be initiated. Because of this, the Italian legal system does not know personal bankruptcy. However, a special law was introduced in 2012 outside of the bankruptcy law (Legge n. 3/2012), which regulates the procedures for addressing overindebtedness of natural persons. The Italian law allows for two financial reorganization procedures, based on which overindebted debtors try to agree on the repayment of their debts with creditors, while the third procedure is similar to our personal bankruptcy and prescribes the liquidation procedure (bankruptcy) of the debtor’s assets and remission of liabilities under certain conditions. The purpose of this diploma thesis is to present the procedures for addressing overindebtedness of natural persons in the Slovenian and Italian legal systems with as little theory as possible, as well as present the main differences between the systems.
