Title:Zaporna kazen - prestajanje, alternativa in sodna rehabilitacija

Abstract:V diplomskem delu je obravnavana zaporna kazen, ki se izvaja v Sloveniji, njeno prestajanje, alternative oblike prestajanja zaporne kazni in sodna rehabilitacija, ki predstavlja izbris obsodbe iz kazenske evidence. V prvem delu diplomskega dela so na splošno predstavljeni instituti, ki so kasneje podrobno opredeljeni. Celotno diplomsko delo tvori potek od izreka zaporne kazni in njenega prestajanja do izbrisa kazenske obsodbe iz kazenske evidence. V osrednjem delu diplomske naloge je predstavljeno prestajanje zaporne kazni v zavodih za prestajanje zaporne kazni po Sloveniji, prav tako je predstavljen potek izvrševanja zaporne kazni. Različni dejavniki so skozi leta privedli do spoznanja, da zaporna kazen ni edina ustrezna oblika kaznovanja storilcev kaznivega dejanja in na podlagi teh dejavnikov so se razvili alternativni načini prestajanja zaporne kazni. V naši veljavni zakonodaji so kot alternativni načini uveljavljeni vikend zapor, hišni zapor in delo v splošno korist, ki so v osrednjem delu diplomskega dela tudi podrobneje predstavljeni. Diplomsko delo se zaključuje z opredelitvijo sodne rehabilitacije kot možnosti, ki obsojencem na podlagi vzornega vedenja nudi izbris iz kazenske evidence in posledično povzroči, da so v družbi obravnavani kot nekaznovani.

Title:Imprisonment - sentence serving, alternative sentences and judicial rehabilitation
Abstract:This dissertation deals with imprisonment in Slovenia, its serving, alternative sentences and judicial rehabilitation, which leads to deletion of the conviction from criminal records. The first part presents institutions, which are later described in detail in the body of the dissertation. The entire dissertation forms the course from the pronouncement of the sentence and imprisonment, up to the deletion of the conviction. In the body of the dissertation the serving of prison sentences in Slovenian prisons are presented, as well as the procedure for execution of the sentence. Different factors over the years have led to the realization that imprisonment is not the only appropriate form of punishment for perpetrators, and based on these factors alternative methods of sentences serving have been developed. In our legislation, the alternative sentences are weekend imprisonment, home incarceration and community service. The dissertation concludes with judicial rehabilitation as an option which offers convicts on the basis of their exemplary behaviour a chance for their criminal record to be deleted from the records which causes them to be treated as non-offenders in society.
