Title:Kazenskopravna analiza kaznivega dejanja detomora

Abstract:Kaznivo dejanje je protipravno dejanje, ki ga zakon zaradi njegove nevarnosti določa kot kaznivo dejanje in hkrati določa njegove znake in kazen zanj. Detomor je kaznivo dejanje, ki se v KZ-1 nahaja v posebnem delu v 119. členu in je milejša oblika uboja. Je posebno kaznivo dejanje, ki ga lahko stori le mati med porodom ali takoj po njem. Ženska stori dejanje pod vplivom posebnega abnormalnega psihičnega stanja, ki nastane zaradi poroda. V prvem delu diplomskega dela je na kratko predstavljena zgodovina in razvoj kaznivega dejanja detomora, saj je pomembno razumeti okoliščine zaradi katerih se to kaznivo dejanje mileje obravnava. Hude stigmatizacije materinstva so tvegale obsežno in agresivno socialno izobčenje zaradi zanositve, ženske so se znašle v hudi stiski, zaradi katere so se odločile pokončati otroka že med porodom ali neposredno po njem. Ravno zaradi tega se je razvila potreba po privilegiranosti tega delikta. Podrobno je opisana tudi problematika, ki se pojavlja v zvezi z detomorom in ureditev tega kaznivega dejanja v slovenski zakonodaji. Drugi del diplome je namenjen obravnavi ureditve detomora v tuji zakonodaji, saj imajo različne države tudi različen pogled na takšno ravnanje in ga tudi vsaka na svoj način obravnavajo. Ta del se podrobneje posveča ureditvi tega kaznivega dejanja v ZDA, Veliki Britaniji in Nemčiji.

Title:Legal analysis of infanticide
Abstract:A criminal act is an unlawful act which determines as a criminal offense, because of its danger and at the same time determines its signs and penalties. Infanticide is a criminal offense, which is found in the special part of Slovenian Criminal Code in Article 119. It is a milder form of murder. It is a special offense that can only be committed by a mother during or immediately after birth. A woman performs an act under the influence of a special abnormal psychological state resulting from birth. In the first part of the diploma thesis, the history and development of the offense of infanticide is briefly presented, since it is important to understand the circumstances that make this offense milder. The severe stigmatization of motherhood risked extensive and aggressive social exclusion due to pregnancy. Women were insevere distres and because of that they decided to kill the child during the birth or immediately after birth. Because of this, the need for the privilege of this delict arised. It also describes in detail the problems that occur in relation to infanticide and the regulation of this crime in Slovenian legislation. The second part of the diploma is intended to address the regulation of infanticide in foreign law, since different countries also have different views of such behavior, and they also treat, the offense of infanticide, each in their own way. This section is focussed on the regulation of this crime in United States, United Kingdom and Germany.
