Title:Pravna vprašanja odpovedi pogodbe o zaposlitvi zaradi neuspešno opravljenega poskusnega dela

Abstract:Diplomska naloga podrobneje proučuje institut poskusnega dela, z vidika novejše sodne prakse in vsebine kolektivnih pogodb iz različnih področij dela in sicer v segmentih, ki se neposredno nanašajo na neuspešno opravljeno poskusno delo, kot enega izmed rednih odpovednih razlogov pogodbe o zaposlitvi. Z ZDR-1, se je spremenila ureditev poskusnega dela, zato se je spremenila tudi sodna praksa. Šest let po spremenjeni ureditvi poskusnega dela, se v zvezi z njim še vedno pojavljajo nekatera pravna vprašanja in pomisleki, ki se študentu prava porajajo ob prebiranju literature, kolektivnih pogodb ter odločitev sodišč. V prvem delu diplomska naloga obravnava pojem in pomen poskusnega dela. V zvezi s tem, opisuje temeljne značilnosti instituta odpovedi pogodbe o zaposlitvi zaradi neuspešno opravljenega poskusnega dela, kakor tudi njegovo razmerje do instituta pripravništva. Obravnava obveznosti delodajalca v zvezi z rokom za odpoved pogodbe o zaposlitvi in vprašanje (ne)obveznosti zagotovitve zagovora. Prav tako obravnava tudi pravico delavca do odpravnine in odpovednega roka. Drugi del diplomske naloge je namenjen primerjavi in podrobnejši analizi različnih kolektivnih pogodb v delu, ki se neposredno nanaša na opravljanje poskusnega dela in z njim povezanih pravnih vprašanj. Prvi sklop drugega dela diplomske naloge se osredotoča na pomen in posamezne značilnosti dogovora strank o poskusnem delu v pogodbi o zaposlitvi. Ta je bistvenega pomena za zakonitost morebitne odpovedi pogodbe o zaposlitvi zaradi neuspešno opravljenega poskusnega dela. Nekaj besed je namenjenih tudi vprašanju dopustnosti dogovora o poskusnem delu v pogodbi o zaposlitvi za določen čas. Z vidika različnih kolektivnih pogodb analizira trajanje poskusnega dela in njegov pomen. Drugi sklop drugega dela podrobneje ureja postopek pred in ob odpovedi pogodbe o zaposlitvi. Z vidika tega podrobneje analizira vlogo in pomen ter pristojnosti ocenjevalnega organa za spremljanje poskusnega dela. Prav tako pa obravnava sam postopek spremljanja in ocenjevanja poskusnega dela z možnostjo vmesnega preizkusa usposobljenosti poskusnega delavca. Na koncu analizira tudi vprašanje objektivnosti ocene poskusnega dela ter seznanitev delavca z njo. Zadnji del diplomske naloge podrobneje obravnava izbrane primere nekatere novejše sodne prakse. Pri tem se v največji meri osredotoča na vsebinske razloge na podlagi katerih je sodišče zavzelo končno odločitev. Prav tako je nekaj besed namenjenih razmerju med ugodno in neugodno rešenimi delovno pravnimi spori v zvezi z odpovedjo pogodbe o zaposlitvi zaradi neuspešno opravljenega poskusnega dela.

Title:Legal issues of dismissal because of unsuccessful probationary period
Abstract:Diploma describes the institute of probationary period, throught the new judicial practice and contents of collective agreements from different field of work namely in segments which are directly connected to unsuccessful probationary period, as one of the regular reasons of dismissal. With ZDR-1, the basic regulation of probationary period has changed, related to this, judicial practice has also changed. Six years after that, it still opens some of legal isues and doubts that a law student has during his reading of literature, collective agreements and judicial decisions. In the first part, the diploma discusses about the concept and meaning of probationary period. In this regard it describes samo of the basic characheristics of dismissal because of an unsuccessful probationary period. as so as its relation to apprenticeship. It deals with the employer's obligations regarding the deadline for termination of the employment contract and the legal issue of (non)obligation to provide a defense. Likewise it discusses about the employee's right to severance pay and notice period. The second part of the diploma is regarded for comparison and analysing different collective agreements in parts, which are directly connected to workers performance during probationary period and legal issues whic are related to it. First complex of second part of the diploma is focused on a concept and characheristics of employement partys agreement about probationary work. This agreement is essential for legal dismissal because of unsuccessful probationary period. It also argues about the issue of admissibility of probationary period agreement in fixed-term contract. From the perspective of various collective agreements, it analyzes the duration of probationary period and its meaning. Second complex of second part of the diploma is related to procedure before and at the time of dismissal. From this point of view it analyses the role, concept and the authority of probationary period assessment body. It also deals with the assessment procedure of employee's work with chance of doing tests during probationary period. Finally, it analyzes the question of the objectivity of the evaluation of the probationary work and the employee's work acquaintance with it. The last part of diploma discusses about the chosen number of cases from the new judicial practise. Related to this it focuse on substantive reasons based on which, the court has made its final decision. Also, a few words are devoted to the relationship between favorable and unfavorable resolved labor disputes concerning the dismissal because of unsucessful probationary period.
