Title:Prostovoljni odstop od kaznivega dejanja

Abstract:Diplomsko delo predstavlja kazenskopravni prostovoljni odstop, njegove značilnosti in pogoje za uporabo. Kaznivo dejanje lahko ostane neizvršeno po storilčevi volji ali pa zaradi objektivne nezmožnosti dokončanja zakonskih znakov kaznivega dejanja. V primeru, da kaznivo dejanje ni izvršeno v celoti zaradi storilčeve odločitve, govorimo o prostovoljnem odstopu od kaznivega dejanja. Prostovoljni odstop se tesno povezuje s poskusom izvršitve kaznivega dejanja, saj od dokončanega kaznivega dejanja ni več mogoče odstopiti. V zvezi s tem pojasnjujem razliko med poskusom in prostovoljnim odstopom, pri katerem posledica ne nastane iz subjektivnih razlogov, ter dalje razliko med možnostjo prostovoljnega odstopa pri dokončanem in nedokončanem poskusu. Omenjam tudi t. i. nekavzalni prostovoljni odstop in poseben primer, ko storilec prostovoljno odstopi od dokončanja kaznivega dejanja, vendar posamezna izvršitvena dejanja predstavljajo kakšno drugo samostojno kaznivo dejanje. V sledečem delu predstavljam tudi udeležence pri kaznivem dejanju in zahteve za sklicevanje na institut prostovoljnega odstopa pri njih. V diplomskem delu ločujem tudi opustitvena kazniva dejanja od storitvenih ter preučujem možnosti in pogoje za upoštevanje določb instituta prostovoljnega odstopa pri opustitvenih kaznivih dejanjih, del zaključnega dela pa namenjam tudi neuspelemu prostovoljnemu odstopu in prostovoljnemu odstopu od trajajočih kaznivih dejanj.

Title:Voluntary abandonment
Abstract:This diploma paper gives a description of the criminal voluntary abandonment of an attempt, its features and conditions for its application. A criminal offence may remain unfinished due to perpetrator’s will or due to objective inability to finish all the elements of a criminal act defined by law. In the event of a criminal offence remaining unfinished due to the perpetrator’s decision alone, we speak of voluntary abandonment of an attempt to commit a crime. A voluntary abandonment is closely associated with an attempt to commit a criminal offence, since it is not possible to abandon a criminal act once it has been committed. In view of this, this paper gives an explanation of the difference between an attempt and a voluntary abandonment where the result is due to subjective reasons, and the difference between the possibility of a voluntary abandonment in case of a finished and unfinished attempt. Non-causal voluntary abandonment is also dealt with as well as the special case when a perpetrator voluntarily desists from committing a crime but individual acts committed represent some other independent criminal offence. This is followed by a presentation of various participants in a criminal act and the requirements for the institute of voluntary abandonment to be referred to. The paper also points out the difference between omissive and commissive criminal offences, and studies the possibility and conditions for the application of the provisions of voluntary abandonment institute to commissive criminal acts. Part of the final division of the paper deals with failed voluntary abandonment and voluntary abandonment in permanent offences.
