Title:Napeljevanje k izvršitvi kaznivega dejanja s strani preiskovalnih organov

Abstract:V diplomskem delu je obravnavano napeljevanje h kaznivim dejanjem s strani organov pregona, torej ko državni organi niso dovolj pasivni pri odkrivanju kriminalnih aktivnosti in posledice takšnih metod dela. V prvem delu diplomskega dela sem opisala temeljne pojme, ki so bistveni za razumevanje entrepmenta. Ti pojmi so kaznivo dejanje, napeljevanje, preiskovalni organi v predkazenskem postopku, prikriti (posebni) preiskovalni ukrepi, tajno policijsko delovanje in tajno policijsko sodelovanje. Osrednji del naloge obravnava policijsko napeljevanje (entrepment), ter subjektivni in objektivni test entrepmenta, na podlagi katerih sodišče presoja ali je bil storilec napeljan k izvršitvi kaznivega dejanja. Sledi analiza nekaterih ključnih odločitev Evropskega sodišča za človekove pravice iz področja napeljevanja tajnih policijskih delavcev k izvršitvi kaznivega dejanja, nato pa poglavje o entrepment obrambi.

Title:Instigating the commission of an offense by the investigating authorities (police entrapment)
Abstract:The final work deals with incitement to criminal offenses by law enforcement agencies, ie when state authorities are not passive enough to detect criminal activities and the consequences of such methods of work. In the first part of my diploma thesis, I described the basic concepts that are essential for understanding the entrepment. These concepts are criminal act, incitement, investigative authorities in pre-trial procedures, concealment (special) investigative measures, secret police operation and secret police cooperation. The central part of the thesis deals with police entrepence, as well as the subjective and objective test of the entrepment on the basis of which the court assesses whether the perpetrator was guilty of committing the crime. This is followed by an analysis of some of the key decisions of the European Court of Human Rights in the field of instigating by secret police officers to commit a criminal offense, followed by a chapter about entrepment defense.
