Abstract:Diplomsko delo obravnava digitalno platformo Uber, ki deluje kot posrednik med vozniki ter med uporabniki, ki potrebujejo prevoz. Predstavlja nove zaposlitvene možnosti osebam, ki bi rade zaslužile vir dohodka kot opravljanje izključno te storitve ali pa kot dodatni vir finančnih sredstev. Aplikacija Uber predstavlja za uporabnike cenovno ugodnejšo obliko prevoza od tradicionalnih avto-taksi prevozov, prav tako so vozila Uberjevih voznikov bolj dostopna in številčnejša, kar uporabniki vidijo kot prednost. V diplomskem delu je izpostavljena tudi socialna varnost Uberjevih voznikov. Ti opravljajo storitve prevoza ob kateremkoli času, na kateremkoli kraju. Plačila za opravljeno delo ne dobijo neposredno. Od zneska posamezne vožnje si Uber odtegne provizijo, preostali znesek vozniku nakaže na bančni račun. Vozniki pa tvegajo tudi možnost izključitve iz aplikacije zaradi nezadostne ocene vožnje (kot tudi ocene voznikov samih), ki jo podajo uporabniki preko aplikacije ob zaključeni vožnji, in sicer anonimno. V mnogih državah Evrope je bila večina storitev, ki jih ponuja Uber, prepovedana. Uber je kot odgovor na to vložil pritožbo na Evropsko komisijo, kjer se sklicuje na svobodo ustanavljanja ter svobodo opravljanja storitev. Diplomsko delo izpostavlja predvsem problematiko kvalificiranja Uberjevih voznikov. Sodišča po Evropi in ZDA se nenehno soočajo z vprašanjem, ali opredeliti voznike partnerje kot neodvisne izvajalce ali pa kot delavce, in to predstavlja trenutno najbolj pereče pravno vprašanje glede aplikacije Uber. Odgovor na to vprašanje je nedavno podalo Sodišče EU, ki je podjetje Uber opredelilo kot prevozno storitev. Posledica te odločitve je, da se bo Uber moral ravnati po pravilih, ki veljajo za tradicionalne avto-taksi službe, Uberjevi vozniki pa bodo deležni ugodnosti, ki pripadajo osebam iz rednega delovnega razmerja.

Title:Challenge of Uber for employment relationships in European union
Abstract:The paper deals with digital platform Uber, that works as an intermediary between providers of transport services and users of the platform. It represents new employment opportunities to drivers, who would like to make income by doing exclusively only these services or just as some extra financial resource. For users application Uber represents reasonably priced way of transport in comparison to traditional taxi car services. Vehicles from Uber drivers are also accessible in bigger numerosity, which is a positive aspect from users perspective. Paper also deals with social security of Uber drivers. They offer transport services at whatever place or time. They are not paid directly. From the amount of each ride, Uber charges a commission, the rest of the earning is transfered to drivers bank account. Drivers carry risk of possibly being banned from application due to insufficiently high grade of the ride (and also of drivers themselves) made anonymously by users through the use of application once the ride is finished. In several countries around Europe, most of transport services offered by Uber, were banned. As response to that, Uber filled an appeal to the European Commission, where he reffers to right of establishment and freedom to provide services. Paper mainly exposes issues around defining Uber drivers. Courts all over Europe and the United States of America are dealing with question whether Uber drivers are independent contractors or employees and it represent one of the most problematic legal issues considering Uber. The Court of Justice of the European Communities (in continuation: ECJ) recently defined Uber as a transport company. Consequences of this decision are that Uber has to comply with the regulations which apply to traditional taxi car services and that Uber drivers will be entitled to employee benefits.
