Title:Avtonomija držav članic EU do podeljevanja socialnih dajatev državljanom drugih držav članic

Abstract:Namen diplomske naloge je raziskati avtonomijo držav članic pri podeljevanju socialnih dajatev državljanom drugih držav članic EU. Izhajam iz tega, da je temelj evropskega povezovanja pravica do prostega gibanja državljanov EU, ki je tudi ena izmed temeljnih svoboščin. Prosto se lahko gibljejo ekonomsko aktivne osebe in ekonomsko neaktivne osebe. V Evropski uniji (odslej EU) je zagotovljeno prosto gibanje delavcev, ki vključuje odpravo vsakršne diskriminacije na podlagi državljanstva delavcev držav članic EU. Delavec (ekonomsko aktivna oseba) ima pravico do dajatev socialne varnosti in socialnih služb, ki nudijo varstvo v primerih, kot so materinstvo, bolezen, nesreče pri delu, odvisnost ali starost ter v primeru izgube zaposlitve, v skladu s pravili, ki jih določajo pravo EU ter nacionalne zakonodaje in običaji. Do teh prejemkov ima pravico v enaki meri kot državljani države gostiteljice. Ekonomsko neaktivnim osebam iz drugih držav članic, pa država članica EU ni dolžna podeliti teh pravic. To je odvisno od držav članic EU in njihove avtonomije, ki je determinirana z novejšo sodno prakso, na katero so znatno vplivale javne razprave o migracijski politiki. Posledično se je v zadnjem obdobju pojavilo v veliko državah članicah EU tudi prepričanje, da ljudje migrirajo predvsem zaradi pridobivanja socialnih ugodnosti, ki vključujejo socialne pravice in dajatve. Zato so države članice EU otežile pogoje za pridobivanje teh pravic. V nedavnih razsodbah Sodišča EU se je razsodilo, da države članice EU omejijo pridobitev nekaterih socialnih dajatev drugim državljanom EU, da bi zaščitile nacionalno blaginjo in s tem znatno povečale svojo stopnjo avtonomije. Sodišče EU je izpostavilo, da je pravica do prebivanja za več kot tri mesece pogojena s tem, da imajo državljani drugih držav članic EU dovolj sredstev zase in za svoje družinske člane in da med njihovim prebivanjem ne bodo postali breme sistema socialne pomoči. Država gostiteljica EU pa tudi ni dolžna podeliti pravice do socialne pomoči v prvih treh mesecih prebivanja.

Title:Autonomy of the EU member states to grant social security benefits to nationals of other member states
Abstract:The purpose of the thesis is to explore autonomy of the EU Member States to grant social benefits to citizens of other EU Member States. The cornerstone of European integration is the right to freedom of movement of EU citizens, which is also one of the fundamental freedoms. Freely can move economically active and economically inactive persons. In the EU is ensured the free movement of workers, which includes the abolition of any discrimination based on nationality of the workers of the EU Member States with regard to employment, remuneration and other conditions of work and employment. Employee (active person) has the right to social security benefits and social services providing protection in cases such as maternity, illness, accidents at work, old-age benefits and benefits in case of loss of employment, in accordance with the rules laid down in EU law and national laws and practices. It has the right to the same extent as the nationals of the host State. However, the EU Member State is not obliged to grant these rights to economically inactive persons. This depends on the EU Member States and their autonomy, which is determined with recent case law, which was significantly influenced by public discussions on migration policy. As a consequence, in many EU Member States a lot of people in the EU have come to the belief that people migrate primarily to obtain social benefits that include social rights and benefits. Consequently, the EU Member States have made it difficult to acquire these rights. In the recent judgments of the EU Court it has been ruled out that EU Member States limit the acquisition of certain social benefits to other EU citizens in order to safeguard national prosperity and thus significantly increase their degree of autonomy. The right to reside for more than three months is conditioned upon sufficient resources for themselves and their family members and that during their stay they will not become a burden on the social assistance system. However, the host Mamber State of the EU is not obliged to grant the right to social assistance during the first three months of residence.
