Title:Cenovna diskriminacija na spletu z vidika Splošne uredbe o varstvu osebnih podatkov

Abstract:V današnjem času se vse več nakupov opravlja preko spleta. Spletno nakupovanje je v veliki meri preseglo tradicionalno nakupovanje zaradi številnih prednosti, ki so potrošniku na voljo. Za spletni nakup morajo potrošniki pred izvedbo nakupa posredovati spletnim ponudnikom osebne podatke, s katerimi se nakup izvede. Ob posredovanju osebnih podatkov se podane informacije pri spletnih ponudnikih zbirajo in hranijo, hkrati pa lahko ponudniki te podatke uporabijo za določanje prodajnih cen blaga in storitev, ponujenih preko spleta. Spletni ponudniki lahko na podlagi podatkov, ki jih pridobijo iz različnih virov, ugotovijo, koliko je posamezni potrošnik pripravljen plačati za določen proizvod in mu glede na to določijo ceno. Glede na potrošnikove osebne preference se cene istega proizvoda med seboj razlikujejo. Tej praksi rečemo cenovna diskriminacija. Splošna uredba o varstvu osebnih podatkov (GDPR) vsebuje številne določbe, ki se nanašajo na cenovno diskriminacijo. V zaključnem delu želim ugotoviti, ali se Splošna uredba o varstvu osebnih podatkov nanaša tudi na spletno diskriminacijo cen in kakšne so posledice uporabljivosti te uredbe za področje spletne cenovne diskriminacije. V prvem delu diplomske naloge je opredeljena cenovna diskriminacija in njeni učinki na družbo glede na njen splošni negativni prizvok. Drugi del pa je osredotočen na Splošno uredbo o varstvu osebnih podatkov in njeno uporabljivost za cenovno diskriminacijo ter pravice, ki pripadajo posameznikom, katerih podatki se obdelujejo. V nalogi ugotavljam, da se pri praksi spletne cenovne diskriminacije pogosto obdelujejo osebni podatki, zaradi česar je Splošna uredba o varstvu osebnih podatkov še posebej uporabna. Spletni ponudniki morajo za obdelavo imeti zakonito podlago, sicer imajo potrošniki na voljo pravice, ki jim jih v primeru nezakonite obdelave podatkov zagotavlja Uredba. Slednja se ne more uporabiti v primeru, ko spletni ponudniki cenovno ne diskriminirajo na podlagi obdelave osebnih podatkov, ampak so različne cene posledica bolj objektivnih dejavnikov, kot so denimo cene ostalih ponudnikov na trgu. Nazadnje ugotavljam tudi, da lahko cenovna diskriminacija kljub njenemu negativnemu prizvoku, pomeni korist tako za ponudnike kot tudi potrošnike, zato bodo morali biti zakonodajalci v prihodnje pri pripravi predpisov, ki bodo omejevali cenovno diskriminacijo, pazljivi, da je ne bi prekomerno omejili.

Title:Online price discrimination from A General Data Protection Regulation perspective
Abstract:Nowadays, more and more purchases are made online. Online shopping is becoming the most popular way to make purchases, due to its advantages consumers see in today’s fast living world. By online shopping, personal data are being collected at an incredible rate. Collected data may be used not only for successful procurement but also to gain information about different prices individuals are willing to pay for the same product. Such practice is called price discrimination. General data protection regulation (GDPR) contains several provisions, related to price discrimination. The purpose of this thesis is to determine, whether the GDPR is applicable to online price discrimination and what are the consequences of its applicability. The first part of the thesis defines the concept of price discrimination and its welfare effects, considering its general dislike. The second part of the thesis is focused on GDPR itself, its applicability to online price discrimination and on the rights that are granted to data subjects. In the thesis I conclude, that with the practice of online price discrimination personal data are often processed, which makes the General data protection regulation applicable. Online providers must have a legal basis for processing, if not the GDPR ensures consumers with various rights, which they can use in the event of unlawful processing. However, the GDPR is not applicable, when online providers do not price discriminate based on processing of personal data and where different prices are due to more objective factors, for instance prices of other market providers. Ultimately, I conclude that price discrimination can also be beneficial both for providers and consumers, despite its negative connotation. Because of that, in the future legislators will need to be prudent when preparing regulations which will limit price discrimination, in order not to restrict it excessively.
