Title:Pojem kolektivnih odpustov v luči novejše sodne prakse

Abstract:V praksi redno prihaja do prenehanj potreb po delu delavcev, pa naj gre za individualne, ali pa za kolektive odpuste. Pravni akti, sploh je za nalogo pomembna Direktiva 98/59/ES, nalagajo delodajalcu v primeru kolektivnih odpustov določene dodatne obveznosti (obveznost posvetovanja z organi na strani delavca, obveznost, da sestavi program razreševanja presežnih delavcev, idr.). V nalogi je razložen pomen pojma kolektivnega odpusta, kot ga razlagata Vrhovno sodišče Republike Slovenije (v nadaljevanju: VS RS) ter Sodišče Evropske Unije (v nadaljevanju: SEU), ker je razumevanje tega pojma ključnega pomena pri razločevanju med individualnimi in kolektivnimi odpusti. Da razumemo sam pojem kolektivnega odpusta, ga je potrebno razčleniti na posamezne (ožje) pojme- to so pojem večjega števila delavcev, pojem delavca, pojem podjetja in obrata in pojem odpusta. V nalogi je vsak pojem obravnavan v posameznem podpoglavju, na način, da je vsak posamezen pojem predstavljen skozi relevantne sodne odločbe, z razlago zadevnih pojmov kot jih razlaga Vrhovno sodišče, ter pomembne odločbe v zvezi s kolektivnimi odpusti, v katerih je razlago pojmov podalo Sodišče EU, in na katere se je Vrhovno sodišče tudi sklicevalo v svojih odločbah. Ker se je v letu 2016 sodna praksa glede razlage določenih pojmov (predvsem katere delavce je treba šteti v kvoto presežnih delavcev) spremenila, sem v nalogi predstavila novejše sodne primere, ki jih je obravnavalo VS RS in SEU. V nalogi je tudi predstavljena ureditev kolektivnih odpustov v Republiki Hrvaški, ki se je kot zadnja država vključila v Evropsko Unijo, ter jo zato prav tako kot ostale države članice zavezujejo evropski pravni akti. Osredotočila sem se na samo ureditev kolektivnih odpustov v hrvaškem zakonu ter na skladnost zakonskega besedila z Direktivo, v zaključku pa sem opravila primerjavo med ureditvama kolektivnih odpustov v Sloveniji in na Hrvaškem.

Title:The concept of collective redundancies in the light of the recent case law
Abstract:There is a regular occurrence of worker work needs, whether it is individual termination of contract between the worker and the employer or in case of collective redundancies. Legal acts, especially important is Directive 98/59/EC, impose on employer in the event of collective dismissals of certain additional obligations (the obligation to consult the authorities on the side of the worker, the oblication to draw up a program of redress of redundant workers, etc.). The theisis explains the meaning of the concept of collective redundancy, as interpreted by the Supreme Court of Republic of Slovenia and the Court of Justice of the European Union because understanding of this concept is of key of importance in distinguishing between individual and collective redundancies. To understand the very concept of collective redundancy, it needs to be broken down into individual (narrower) concepts- this is the notion of a large number of workers, the concept of a worker, the concept of establishment and the concept of redundancy. In the theisis, eac term is dealt with in each subsection, in such a way that each particular concept is presented through the relevant court decisions, the interpretation of the relevant concepts as interpreted by the Supreme Court, and the important decisions concerning collective redundancies in which the interpretation of the terms was given by the Court of EU, and to which the Supreme Cours also referred to in its decisions. Since in 2016 case-law on the interpretation of certain concepts (in particular which workers should be counted in the quota of redundant workers) has been changed, I presented recent court cases dealt with by the Supreme Court of Slovenia and the Court of Justice of the European Union. The theisis also presents the system of collective redundancies in the Republic of Croatia, as the last Member State to enter European Union, and is therefore bound by European legal acts as other Member States. I focused on the system of collective redundancies in the Croatian national law and on the harmonisation of the relevant legal text of the Directive 98/59 in the Croatian national law, and in conclusion a comparison between the collective redundancies in Slovenia and Croatia was made.
