Title:Kriminološki in viktimološki vidiki dopinga v vrhunskem športu : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:Doping v športu je sredstvo, ki se ga zlorabi za dosego vrhunskih rezultatov. Oseba pod vplivom dopinga je v vsakem primeru žrtev, vendar na način zlorabe ločimo kriminološki in viktimološki vidik. Zaradi slednjega se je porodilo vprašanje, zakaj na vse športnike gledamo enako, pa čeprav so lahko le žrtev druge osebe. Skozi primere smo odkrili, da se športnik lahko hitro pojavi v vlogi žrtve, ker nima drugega izhoda na poti svoje kariere. Analizirali smo najodmevnejše športnike, ki so konzumirali prepovedane substance v Sloveniji in v svetu. Želeli smo prikazati, da je viktimološki vidik uporabe dopinga močno prisoten na vseh področjih vrhunskega športa. Da bi širjenje dopinga zajezili in preprečili,bi morali antidopinški organi zaostriti kazni. Prišli smo do predloga ničelne tolerance do kršiteljev, torej prepoved nastopanja na vseh tekmovanjih višjega ranga, ki se kakorkoli točkujejo s strani panožnih zvez. Drugi predlog bi bil vsekakor večje finančno breme, vendar možna rešitev. V vsako panožno zvezo države bi mednarodna antidopinška organizacija s pomočjo nacionalne antidopinške organizacije postavila človeka, ki bi skrbel in varoval športnike pred uporabo dopinga. Delo bi zajemalo vse od prehrane, pregledov krvnih slik do informiranja z novimi dopinškimi pravili ter do posodabljanja doping liste. Kakorkoli dopinga v športu ni moč popolnoma preprečiti, saj ga tudi ljudje ne jemljejo kot kriminalno dejanje. Spoznali smo, da je več žrtev, ki se zavedajo uporabe dopinga, poleg tega pa so kazni neenakomerno razporejene.

Title:Criminological and victimological aspects of doping in elite sport
Abstract:Doping in sport is a means of abuse to achieve the best possible results. A person under doping influence is a victim in every way, but in the way of abuse we distinguish between criminological and victimological aspects. Therefore a question arises. Why do we look the same at athletes when they come in contact with doping, although they might be just victims of another person? Through examples we discovered that an athlete quickly appears a victim, because he/she does not see any other way on his career path. We analyzed the most famous athletes, who consumed prohibited substances in Slovenia and in the world. We wanted to show that victimological aspect of the doping use is strongly presented in all areas of top level sport. Anti-doping authorities should tighten penalties if they really want to prevent doping proliferation. Our first proposal is zero tolerance for all offenders, i.e. a life ban of performing in all higher-level competitions, which are in any way scored by sport associations. The second proposal or solution would definitely be a higher financial burden. With the help of national anti-doping organization, the World Anti-doping Agency should delegate a person, who would supervise and protect athletes before using doping regardless of the sport industry. The work of the delegate would cover everything from nutrition, blood tests, informing about doping rules and doping list modifications. However, doping in sports cannot be completely prevented, because people do not consider it as a criminal act. We have come to the realization, that there is significant number of sportspeople, who are aware of doping abuse and sanctions, further more are the punishments unequally distributed.
