Title:Pridobivanje obveščevalnih podatkov s pomočjo nadzora komunikacijskih sistemov : diplomsko delo visokošolskega študija Varnost in policijsko delo

Abstract:Obveščevalne službe zbirajo javne in tajne podatke, jih vrednotijo in analizirajo. Pri tem uporabljajo različne metode pridobivanja podatkov, od človeških virov, tehničnih sredstev, javno dostopnih virov, do mednarodnega sodelovanja. Pridobivanje podatkov s pomočjo tehničnih sredstev (ang. SIGINT) je metoda, s katero se zbira podatke, ki se prenašajo v obliki elektromagnetnega valovanja po najrazličnejših medijih, in se deli na več podzvrsti. Za obveščevalne službe je pomembna podzvrst, ki omogoča nadzor komunikacij (ang. COMINT). COMINT omogoča nadzor medijev, po katerih se prenašajo govor in drugi zvočni zapisi, pisni dokumenti, slikovna gradiva in podatki. Izvaja se s stacionarnimi ali mobilnimi napravami. Sodobni nadzorni sistemi omogočajo prisluškovanje praktično vsem oblikam komunikacij po vsem svetu. Najbolj znani sistemi za nadzor komunikacij so: UKUSA, Echelon, Carnivore, Bundestrojaner, Magic Lantern, Prizma, ThinThread in Trailblazer. V večini držav nadzor nacionalnega telekomunikacijskega sistema spada v delovno področje varnostnih služb, ki se ukvarjajo s področjem nacionalne varnosti, varstva ustavne ureditve in zatiranja hujših oblik kriminala. S to metodo se posega v z ustavo zagotovljene človekove pravice o tajnosti komunikacij. V mednarodnih sistemih pa se pojavljajo tuji uporabniki, za katere ne velja ustavna zaščita tajnosti komuniciranja. Za razliko od nacionalnega sistema se lahko v mednarodnem sistemu brez omejitev nadzirajo vse komunikacije. Pri nadzoru komunikacij večkrat pride do zlorab, kar privede do afer. V zadnjih letih je javnost najbolj razburil Edward Snowden s svojim razkritjem nadzornega programa Prizma, s katerim ameriška NSA prisluškuje telefonskim pogovorom in zbira podatke iz spletnega komuniciranja. Pojavljajo pa se tudi afere, kjer s strani obveščevalne službe ni kršena zakonodaja, temveč so podatki, ki jih obveščevalne službe pridobijo s pomočjo posebnih oblik pridobivanja podatkov, zlorabljeni za doseganje določenih političnih ciljev. Ena od takih afer v Sloveniji je afera Janša-Sanader.

Title:Intelligence gathering through surveillance of communications systems
Abstract:Intelligence services generally gather, evaluate and analyse public or classified information. By doing so, they use specific methods: Human Intelligence, Signal Intelligence, Open Source Intelligence and intelligence-gathering with the help of international cooperation. Signal Intelligence (SIGINT) is a method, which includes gathering of information transferred in form of electromagnetic waves over a variety of media. This method has additional subtypes. Intelligence services mostly rely on the subtype, which enables control of communication (COMINT). COMINT allows them to control the media, through which speech and other audio tracks, written documents, image material etc. are being transferred. It is performed through stationary and mobile devices. Modern control systems allow surveillance of practically all types of communication across the world. The most well-known systems for communication control are: UKUSA, Echelon, Carnivore, Bundestrojaner, Magic Lantern, PRISM, ThinThread and Trailblazer. In most countries, control of the national telecommunication system is part of the work field of security services, which are active in the field of national security, the protection of the constitutional order and suppression of serious crime. This method interferes with the constitutionally guaranteed human rights relating to secrecy of communication. However, in international systems there are foreign users, who are not subjected to the constitutional protection of the secrecy of communication. Unlike in the national system, in the international system all communication can be surveilled without limitations. The control of communications is subjected to repeated abuse, leading to scandals. In recent years, the public has been mostly agitated by Edward Snowden with his disclosure of the surveillance program PRISM, through which the NSA surveils phone calls and gathers information from online communications. There are also emerging scandals, where intelligence services do not break the law, but the information, which they gather by special means of data gathering, is misused in order to achieve certain political goals. One of such scandals in Slovenia is the scandal Janša-Sanader.
