Title:Kriminalistični vidiki otroške srčne kirurgije - analiza časopisnih člankov : diplomsko delo univerzitetnega študija

Abstract:V zadnjem času smo lahko priča številnim aferam in napakam v zdravstvu. Ena izmed njih je tudi zgodba o otroški srčni kirurgiji, ki je vrhunec medijske pozornosti dosegla po objavi ugotovitev mednarodne komisije za presojo leta 2015. Javnost ima delno pravico do obveščenosti tudi z dogajanjem v zdravstvu. Mediji z objavami zdravniških nepravilnosti pripomorejo k oblikovanju javnega mnenja. Na podlagi analize časopisnih člankov smo ugotovili, da otroci največkrat niso prioriteta v člankih. Več pozornosti se posveča vodstvu in zdravnikom Univerzitetnega kliničnega centra Ljubljana. Prav tako smo v povezavi s slikovnim gradivom ugotovili, da so v člankih najpogosteje slike odgovornih za napake v programu otroške srčne kirurgije, sledijo simbolične slike otrok, bolnišnični posnetki in v zelo majhnem obsegu tudi slike staršev in otrok iz programa otroške kardiokirurgije. V diplomskem delu smo z analizo poročanja medijev poskušali odgovoriti na zlata kriminalistična vprašanja. Ugotovili smo, da so mediji odgovornost za napake v programu otroške srčne kirurgije pripisali otroškim srčnim kirurgom in vodstvu Univerzitetnega kliničnega centra Ljubljana, še preden so bili končani sodni postopki in pravnomočno dokazana krivda. Žrtve so bili otroci, ki so zaradi zdravljenja v programu otroške srčne kirurgije umrli ali utrpeli trajne zdravstvene posledice. Na vprašanje o tem, kaj se je zgodilo, smo na podlagi analize poročanja dobili odgovor, da je šlo za zdravniške napake, malomarno zdravljenje, smrt otrok in trajne zdravstvene posledice zaradi nepravilno izvedenih operativnih posegov in neprimerne pooperacijske obravnave. V povezavi z visokimi plačili otroških srčnih kirurgov in napotitvami otrok na zdravljenje v tujino so mediji izpostavili tudi korupcijo.

Title:CRIMINAL INVESTIGATION ASPECTS OF CHILDREN
Abstract:Recently, newspapers have published several reports on medical errors. The state of affairs in children’s cardiac surgery have also been covered, with media attention peaking after the 2015 release of the international audit committee findings. The public has the right to be informed to a certain extent also on the state of healthcare affairs. Media releases on medical errors therefore help form the public opinion. We analysed newspaper articles on children’s cardiac surgery errors and focused on criminal investigation aspects. The analysis showed that newspaper articles do not focus on children quite often. Attention is more often given to the management of healthcare providers and physicians of the Univerzitetni klinični center Ljubljana (UKCL, University Medical Centre Ljubljana). As far as images in the articles are concerned, we noted the following order of importance: the photographs of children’s cardiac surgery personnel responsible for medical errors were most common, followed by symbolic pictures of children, photos of hospital wards, and very rarely also by photos of parents and children included in children’s cardiac surgery. We analysed newspaper articles in our assignment focusing on standard criminal issues/golden questions. According to the research done, the roles of perpetrators and accomplices were interchangeably assumed by cardiac surgeons and the management of the UKCL. The victims were children included in the children’s cardiac surgery programme in the period from 2007 to 2014. The investigation of what had happened exposed medical errors, negligent treatment, death of children, and irreversible patient harm due to medical errors during surgeries. Sometimes media also focused on corruption.
