Title:ETIČNE DILEME SPLETNEGA PIRATSTVA

Abstract:V magistrski nalogi obravnavamo spletno piratstvo iz etičnega ter ekonomskega vidika. Piratstvo je dejavnost, kjer se kršijo avtorske pravice določene osebe. O spletnem piratstvu pa govorimo takrat, kadar gre za nelegalno kopiranje in prenašanje avtorsko zaščitenih vsebin z interneta. Internet je okolje, ki uporabnikom daje vtis, da so njihova dejanja brez posledic, kar botruje večji naklonjenosti spletnemu piratstvu. Slednja oblika je dandanes najbolj razširjena in predstavlja veliko grožnjo industrijam programske opreme in medijskih datotek. Težko je natančno določiti stopnjo spletnega piratstva in njegov vpliv na zakonito prodajo. Vendar lahko z gotovostjo trdimo, da je piratstvo velik problem predvsem med mladimi. Visoka stopnja piratstva je privedla do nedavnih sprememb na področju prava glede ustreznejše zaščite intelektualnih pravic na internetu. Kljub številnim aktivnostim in ukrepom organizacij v boju proti spletnemu piratstvu ne prihaja do znatnega upadanja spletnega piratstva. Magistrsko delo je sestavljeno iz dveh delov, in sicer iz teoretičnega in empiričnega dela. V teoretičnem delu opredelimo pojem etike in morale ter etičnost uporabe spleta. V nadaljevanju obravnavamo obstoječa spoznanja s področja spletnega piratstva. Osredotočili smo se na dejavnike, ki vplivajo na stopnjo spletnega piratstva, na njegove prednosti in slabosti za posamezne udeležence in finančne posledice, ki jih prinaša spletno piratstvo avtorjem in industrijam ter boj teh organizacij proti piratstvu. Poudarek smo dali etičnim dilemam spletnega piratstva z argumenti za in proti ter raziskavam, ki so bile že izvedene na tem področju. V študijah, izvedenih na temo spletnega piratstva, je piratstvo označeno kot neetično obnašanje. Z vidika posameznikov spletno piratstvo uvrščamo med etične dileme, saj se posamezniki zavedajo, da počnejo nekaj narobe, vendar zaradi vpliva ostalih odločujočih dejavnikov jim njihova dejanja ne predstavljajo spornosti. Etika deluje v ozadju, ko se uporabniki spleta odločijo za nezakonit prenos vsebin. Kljub prevladujočemu prepričanju da spletno piratstvo ne posega v moralo in etiko, veliko ljudi poskuša racionalizirati svoje ravnanje z različnimi tehnikami upravičevanja. V empiričnem delu magistrske naloge smo analizirali rezultate raziskave, ki je bila izvedena med slovenskimi in britanskimi uporabniki spleta. Analizirali smo odnos posameznikov do spletnega piratstva z izbranim vidikom etične obravnave in ekonomskega vidika. Glavni namen naloge je preučiti etična stališča uporabnikov ter vpliv odločujočih dejavnikov na prenašanje nelegalnih vsebin s spleta. Na podlagi ugotovitev iz raziskave smo v nadaljevanju oblikovali predloge za zmanjšanje stopnje spletnega piratstva, saj po teoretičnih izhodiščih spletnega piratstva trenutno še ni mogoče popolnoma preprečiti. Magistrsko nalogo smo zaključili s predstavitvijo odprtih problemov s področja spletnega piratstva za nadaljnjo raziskavo.

Title:ETHICAL DILEMMAS OF ONLINE PIRACY
Abstract:This master’s thesis covers online piracy from the ethical and economical point of view. Piracy is defined as an activity, where a subject's copyrighted material is infringed. We talk about online piracy when we describe illegal copying and downloading of copyrighted material from the Internet. The Internet is an environment, where people get the impression that their actions are without consequences, which leads to greater sympathy for online piracy. The latter form is now the most widespread and poses a major threat to the software industry and industry of media files. It is difficult to accurately determine the degree of online piracy and its impact on legitimate sales. However we can say with certainty, that piracy is a big problem, especially among young people. The high level of piracy has led to the recent changes in the law, with better protection of intellectual property rights with its presence on the Internet. Despite the large number of activities and actions performed by organizations, which are fighting against online piracy, there is no significant decline in the rate of online piracy. This master's thesis consists of two parts, namely the theoretical and empirical part. In the theoretical part we define the concept of ethics, morals and ethical use of the Internet. Next, we deal with the existing knowledge in the field of online piracy. We have focused on the factors that affect the rate of online piracy, its advantages and disadvantages for individual participants, financial implications associated with online piracy affecting authors and industries and war against piracy by these organizations. Emphasis will be placed on ethical dilemmas of online piracy with the arguments for and against, and research that has already been made in this area. In studies conducted on the topic of online piracy, piracy is characterized as unethical behavior. We have included online piracy in the ethical dilemmas from the viewpoint of individuals; because subjects realize what they are doing is wrong, although they determine, with the influence of other factors, their actions as non-controversial. When web users decide to illegally transfer files, their ethics work in background. Despite the prevailing belief that online piracy does not interfere with the morality and ethics, many people try to rationalize their behavior with different justifying techniques. We have analyzed the results of the survey, which was carried out between Slovenian and British internet users, in the empirical part of the master's thesis. We analyzed the relationship between individuals and online piracy, where aspect of ethical consideration and economic perspective were selected. The main purpose of this thesis is to examine user's ethical point of view and the influence of the determinant factors on the illegal transferring of content from the Internet. Based on the survey findings we then developed proposals to reduce the rate of online piracy, although theoretically it is impossible to completely prevent online piracy. We have completed the master's thesis with the presentation of open problems for further research in the area of online piracy.
