Abstract:Kriminalistična policija za uspešno odkrivanje organiziranih oblik kriminalitete poleg standardnih policijskih ukrepov uporablja še prikrite preiskovalne ukrepe. Ti vsebujejo več različnih ukrepov in tajno delovanje je eden izmed njih. S tem ukrepom policiji uspe razkriti še tiste organizirane kriminalne skupine, ki jih z drugimi ukrepi ni bilo mogoče. V diplomski nalogi se najprej osredotočimo na prikrite preiskovalne ukrepe, jih na kratko opredelimo in predstavimo njihove značilnosti. Po seznanitvi s prikritimi preiskovalnimi ukrepi je opredeljen ukrep tajnega delovanja policije, ki je temelj naše diplomske naloge. V tem poglavju spoznamo tajno delovanje na splošno, njegovo zakonsko ureditev, tajne delavce, ki ta ukrep izvajajo, njihove značilnosti ter tudi problematiko pri izvajanju tajnega delovanja. V nadaljevanju za lažje razumevanju ureditve tega ukrepa pri nas predstavimo še ureditev tajnega delovanja v nekaterih drugih državah. Seveda pa ne moremo mimo tega, da ne bi raziskali, kakšen je poseg tajnega delovanja v človekove pravice in temeljne svoboščine, zaradi možnosti zlorab pa predstavimo tudi sistem nadzora nad tajnim policijskim delovanjem.

Title:COVERT POLICING
Abstract:For the successful detection of organized forms of criminality, criminal police, in addition to standard policing, also uses covert investigative measures. Covert investigative measures include various measures and covert policing is one of them. With this measure, the police can disclose those organized criminal groups which disclosure by other means was not possible. The thesis firstly focuses on covert investigative measures. They are briefly defined and we present their features. After noting the undercover investigative measures we define covert policing, which is the main foundation of our thesis. In this chapter we introduce covert policing in general, its regulation, undercover agents carrying out this measure, their characteristics and problems in implementing covert policing. To facilitate the understanding of covert policing in Slovenia, we introduce its regulation in some other countries. Of course we can’t ignore the impact of covert policing in human rights and fundamental freedoms and because of the possibility of abuse, a system of control over covert policing is also presented.
