Abstract:
Pojem ekonomsko odvisnih oseb je v slovenskem pravnem redu relativno nov, saj ga pred uveljavitvijo novega Zakona o delovnih razmerjih (Ur.l. RS, št. 21/13, 78/13 - popr.) nismo poznali. Tej kategoriji oseb je pod določenimi pogoji priznana omejena delovnopravna zaščita ne glede na to, da storitve opravljajo po pogodbah civilnega prava. Namen diplomskega dela je predvsem prikazati in kar se da podrobno razčleniti zakonsko ureditev ekonomsko odvisnih oseb. Pri tem bomo poskušali izpostavili vprašanja oziroma odprta področja, ki z zakonodajo niso povsem urejena. Hkrati bomo predstavili sistem in način sodelovanja družbe XY, d.o.o. z zunanjimi izvajalci. Obstoječi sistem sodelovanja bomo nato analizirali v luči obstoječe delovnopravne zakonodaje, pri čemer bomo posebej izpostavili možnost zunanjih izvajalcev, da uveljavljajo status ekonomsko odvisne osebe. Posebno pozornost bomo namenili obsegu pravic, ki jih družba zagotavlja zunanjim izvajalcem in jih analizirali v luči pravic, ki jih Zakon o delovnih razmerjih podeljuje ekonomsko odvisnim osebam.

Title:
ECONOMICALLY DEPENDENT PERSONS IN XY, D.O.O.
Abstract:
The concept of economically dependent persons is relatively new in the Slovenian legal system, as it was unknown prior to the enactment of the new Labour Relations Act (Ur.l. RS, št. 21/13, 78/13 - popr.) This category of persons is entitled, under certain conditions, to limited Labour protection, irrespective of the fact that services are provided under contracts of civil law. The aim of this diploma is to present and study in detail the regulation of economically dependent persons. In doing so, we will try to highlight issues or areas in the law that are not fully regulated. At the same time, we will present the system of cooperation between the company XY, d.o.o. with external contractors. The existing system of cooperation will then be analyzed in the light of existing labor legislation, where we will highlight the possibility of external contractors to assert the status of economically dependent persons. Particular attention will be paid to the extent of rights, the company provides to external contractors in general and which will be analyzed in the light of the rights that Labour Relations Act confers on economically dependent persons.
