Abstract:Stavka je sredstvo za varovanje interesov delavcev. Od vseh oblik industrijskih akcij je v našem pravu opredeljena samo stavka, ki jo Zakon o stavki v 1. odstavku 1.člena opredeljuje kot organizirano prekinitev dela delavcev za uresničevanje ekonomskih in socialnih pravic in interesov iz dela. Delavci z njo organizirano, kolektivno in zavestno izrazijo svoje nezadovoljstvo. Za ta pravni institut je značilna organizirana ustavitev dela, ki jo vodi predstavniška organizacija delavcev imenovana sindikat oziroma izjemoma drugi subjekti. Dovoljeno jo je izvesti po postopku, ki je določen v posameznih pravnih ureditvah in kot zadnje sredstvo. Pred samo izvedbo stavke je večinoma potrebno izvesti pomiritveni postopek. Ustava Republike Slovenije v 2. odstavku 77. člena dopušča, da se pravica do stavke z zakonom omeji, če to zahteva javna korist, pri čemer je potrebno upoštevati vrsto in naravo dejavnosti. Pravica do izvrševanja stavke delavcev v državnih organih in delavcev v javnih službah je omejena z Zakonom o stavki in posebnimi zakoni, saj delavci s svojim ravnanjem ne škodijo samo sebi in delodajalcu, temveč tudi drugim.

Title:Regulation of strike in Republic of Slovenia
Abstract:Strike is a mean to protect the interests of workers. From all forms of industrial actions is in our law defined only the strike, which is defined as an organized workers interruption of work for realisation of economic and social rights and interests. Workers use it to organized, collective and consciously express their dissatisfaction. It is a legal law institute which is characterized by organized shutdown and is led by representative workers organization named trade union or, exceptionally other entities. It is allowed to perform it after the procedure in legal arrangements and as the last action. Before the strike realises is mostly obligatory to carry out an appeasement procedure. The Constitution of the Republic of Slovenia in 2. Paragraph of 77. Article allows the limitation of the strike because of the public benefits. Although we need to consider the type and nature of activities.The right to strike is limited for the workers in national authorities and workers in public services with Strike Act and special laws because workers with its action do not harm only themselves and employer but also other people.
