Title:Problematika prepovedanih drog na območju Gorenjske : magistrsko delo

Abstract:Magistrsko delo temelji na analizi statističnih podatkov, ki predstavljajo število kaznivih dejanj in prekrškov povezanih s prepovedano drogo na območju Gorenjske. Slovenska zakonodaja določa, da so kazniva dejanja neupravičena proizvodnja in promet z mamili, nedovoljenimi snovmi v športu in s predhodnimi sestavinami za izdelavo drog ter omogočanje uživanja prepovedanih drog ali nedovoljenih snovi v športu. Posest prepovedanih drog za lastno uporabo, pa se obravnava kot prekršek. V prvem delu magistrskega dela sem opredelil osnovne pojme povezane s prepovedanimi drogami, opisal sem transport prepovedanih drog, kriminaliteto povezano s prepovedanimi drogami in zakonodajo, ki ureja področje prepovedanih drog. V drugem delu magistrskega dela sem se osredotočil na problematiko povezano s prepovedanimi drogami na območju Gorenjske. Opisal sem takrat zelo odmevno, tako imenovano »gorenjsko heroinsko navezo«, ko je bilo zaradi tihotapljenja prepovedanih drog aretiranih večje število gorenjskih avtoprevoznikov. Navedel pa sem tudi odmevne gorenjske primere zasega drog. Na podlagi statističnih podatkov, pridobljenih iz evidenc policije, sem poskušal ugotoviti porazdeljenost kaznivih dejanj in prekrškov povezanih s prepovedano drogo po posameznih območjih na Gorenjskem. Postavil sem tri domneve, pri čemer sem na podlagi statističnih podatkov dve domnevi potrdil, eno pa zavrgel. Potrdil sem domnevo »prisotnost drog na Gorenjskem je večja v večjih mestih«. Ugotovil sem, da je v večjih mestih večje število odkritih kaznivih dejanj in prekrškov povezanih s prepovedano drogo. Prav tako sem potrdil domnevo »ukrepi policije na področju prepovedanih drog sovpadajo s področjem prekrškov in kaznivih dejanj«. Ugotovil sem namreč, da je število odkritih kaznivih dejanj naraščalo do leta 2009, nato pa strmo padalo vse do zadnjega analiziranega leta. Število prekrškov se je sicer po posameznih letih spreminjalo, vendar odstopanja niso izrazita. Na podlagi podatkov pa sem ugotovil, da število storjenih kaznivih dejanj sovpada s številom ugotovljenih kršitev s področja prepovedanih drog, saj je bilo največ storjenih kaznivih dejanj in ugotovljenih prekrškov v večjih občinah, število pa z manjšimi odstopanji pada po velikosti in oddaljenosti občine od večjih urbanih mest. Zavrgel sem domnevo »ukrepi policije na področju prepovedanih drog na Gorenjskem naraščajo«. Ugotovljeno je bilo namreč, da se zmanjšuje število odkritih kaznivih dejanj uje. Število ugotovljenih kršitev se je sicer zadnja leta nekoliko povečalo, vendar odstopanja po posameznih letih niso izrazito velika.

Abstract:The dissertation is based on the analysis of the statistical data that show the number of criminal acts and misdemeanours connected with illegal drugs in the area of Gorenjska (Upper Carniola). Slovenian law stipulates that unjustified or illegal drug production and drug trafficking or trafficking of illicit stimulants used in sport, as well as enabling the use of drugs or illicit stimulants, are illegal acts. The possession of illegal drugs for personal use is considered a misdemeanour. In the first part of the dissertation the elementary concepts connected with illegal drugs are defined. The transport of illegal drugs, the criminality connected with illegal drugs and legislation that regulates the rules of how to deal with illegal drugs are described. In the second part of the dissertation the attention is given to the problems connected with illegal drugs in the area of Gorenjska (Upper Carniola). In the dissertation the then infamous, so called “Upper Carniolan heroin connection”, in which a high number of Upper Carniolan hauliers were arrested due to illegal drug smuggling is described. Listed are also the infamous Upper Carniolan cases of drug confiscations. Based on the statistical data obtained from police records an attempt to establish the distribution of criminal acts and misdemeanours connected with illegal drugs in individual areas of Gorenjska (Upper Carniola) was made. Three suppositions were made; two of the suppositions were confirmed based on the statistical data, whereas one was rejected. The supposition that the presence of drugs in Gorenjska (Upper Carniola) is stronger in larger cities was confirmed. It was established that in larger cities the higher number of uncovered criminal acts and misdemeanours are connected with illegal drugs. Additionally, confirmed was the supposition that “the number of measures taken by the police against illegal drugs coincided with criminal misdemeanours and acts”. Namely it was established that the number of uncovered criminal offences had been increasing until 2009. After which the number of uncovered criminal offences started to decrease and was decreasing up until the last analysed year. The number of misdemeanours changed in each individual year; however, the deviation is not distinct. Based on the data it was revealed that the number of criminal acts coincided with the number of misdemeanours concerning illegal drugs, since the most commonly committed criminal acts and misdemeanours occurred in larger municipalities, whereas the number of these criminal acts, with minor deviation, is lower if a municipality is smaller or more distant from larger urban areas. The supposition that “the number of measures taken by the police against illegal drugs in Gorenjska (Upper Carniola) have been increasing”, was discarded, since it was established that the number of uncovered criminal acts has actually been decreasing. The number of established misdemeanours has somewhat increased in past years; however, the deviation is not distinct.
