Abstract:Javno naročanje je dejavnost, ki predstavlja oskrbo javnega sektorja z blagom, storitvami in gradbenimi deli s ciljem pridobiti na podlagi vnaprej določnega postopka in na podlagi pridobitve več konkurenčnih ponudb najugodnejšega ponudnika. Zaradi neupoštevanja temeljnih načel javnega naročanja in etičnih meril javnih uslužbencev ter posledičnega nepravilnega ravnanja v postopkih javnega naročanja (ki so lahko tudi posledica nepoznavanja veljavnih predpisov) pogosto prihaja do koruptivnih dejanj v postopku. Nemalokrat se zgodi, da naročnik prilagodi javno naročilo ali njegov element določenemu ponudniku in mu tako omogoči, da je izbran v postopku. Kljub nadzoru določenih institucij nad postopki, korupcija še vedno spodjeda sistem javnega naročanja, kar dokazujejo prijave sumov koruptivnih dejanj s strani neizbranih ponudnikov. Niti sprememba zakonodaje ali še bolj poostren nadzor nad delom naročnikov in ponudnikov ne bosta mogla zatreti korupcije v sistemu javnega naročanja.

Abstract:Public procurement is an activity, which represents public sector supply of goods, services and construction, with the aim to obtain on the basis of work in advance of the procedure and on the basis of more competitive bidding the award. As a result of failure to comply with the fundamental principles of public procurement and ethical public servants and the resulting irregular practices in public procurement procedures (which may also result from ignorance of the applicable regulations) often acts in the process. Often it happens that the contracting authority is adjusted to a specific element of the contract or its service provider and allow him to be selected in the process. Despite the control of certain institutions of the above procedures, corruption is still undermining the system of public procurement, which is evidenced by the reports of suspected acts of unselected. A change in the legislation or more stringent supervision of the work of subscribers and service providers will not be able to suppress corruption in public procurement system.
