Title:SKLEPANJE POGODB O ZAPOSLITVI ZA DOLOČEN ČAS

Abstract:S podpisom pogodbe o zaposlitvi se med delavcem in delodajalcem ustvari delovno razmerje. Pogodbo o zaposlitvi za določen čas ureja Zakon o delovnih razmerjih kot eno izmed podlag za nastanek delovnega razmerja, vendar z določenimi posebnostmi. Zakon o delovnih razmerjih izhaja iz načela, da je pogodba o zaposlitvi za nedoločen čas pravilo, pogodba o zaposlitvi za določen čas pa izjema. Ker je vsako leto zaposlitev za določen čas več, smo se odločili, da bomo v magistrskem delu raziskali in analizirali ali se pogodbe o zaposlitvi za določen čas na Javnem zavodu RS za varstvo kulturne dediščine sklepajo v skladu z zakonodajo ter skušali ugotoviti ali se na novo zaposluje za določen ali nedoločen čas. Rezultati magistrske naloge so pokazali, da je sklepanje pogodb za določen čas na Javnem zavodu RS za varstvo kulturne dediščine v skladu z zakonodajo in da se z vsemi novimi delavci sklene pogodbo o zaposlitvi za določen čas na podlagi dopustnega razloga in v skladu s časovno omejitvijo. Reforma trga dela skuša zagotoviti manjši delež zaposlovanja za določen čas tako, da je bilo sprejetih kar nekaj ukrepov za destimulacijo zaposlovanja za določen čas in stimulacijo zaposlovanja za nedoločen čas, vendar je vprašanje, če bodo temu sledili tudi delodajalci.

Title:FIXED-TERM EMPLOYMENT CONTRACTS
Abstract:By signing an employment contract an employment relationship is created between the worker and the employer. Fixed-term employment contract is regulated by the Employment Relationship Act as one of the basis for creating an employment relationship, but with distinctive features. Employment Relationship Act is based on the principle that the employment contract for an indefinite period is the rule and that the fixed-term employment contract is an exception. As the number of fixed-term employment contracts grows every year, we have decided to explore and analyse in this Master's thesis whether the fixed-term employment contracts at the Institute for the Protection of Cultural Heritage of Slovenia are concluded in accordance with the legislation, and tried to determine whether the new employment contracts are fixed-term or for an indefinite period. The results of the Master's thesis have shown that concluding fixed-term employment contracts at the Institute for Protection of Cultural Heritage of Slovenia are in accordance with the legislation and that all fixed-term employment contracts made with new workers are based on admissible reasons and are in accordance with the limitation of the total duration of successive fixed-term employment contracts. The labour market reform seeks to ensure a lower percentage of fixed-term employment contracts by adopting several measures to de-stimulate employing for a fixed-term and stimulate employing for an indefinite period. Whether the employers follow these measures is yet to be seen.
