Abstract:Obveznost prodajalca pri prodajni pogodbi je izročitev stvari, ki je po kakovosti v skladu s pogodbo oz. nima napak. Predmet pogodbe oz. stvar, ki je predmet pogodbe, ima lahko napake, pravne ali stvarne. Prodajalec je odgovoren za stvarne napake, če so izpolnjeni zakonski pogoji. Kupec je dolžan prejeto stvar na običajen način pregledati ali jo dati v pregled in o napakah obvestiti prodajalca. Kupec, ki je o napaki pravočasno in pravilno obvestil prodajalca, lahko zahteva od njega, da napako odpravi ali mu izroči drugo stvar brez napake (izpolnitev pogodbe), zahteva znižanje kupnine, odstopi od pogodbe. Gre za jamčevalne zahtevke, ki jih mora kupec uveljaviti v določenem roku. Če rok zamudi, izgubi pravice (zahtevke), ki mu gredo iz tega naslova. Kupec tako lahko uveljavlja svoje pravice iz naslova stvarne napake le, če o napaki pravočasno obvesti prodajalca. Direktiva 1999/44/ES je potrošniška direktiva na evropski ravni, s katero morata biti usklajena OZ in ZVPot. ZVPot kot specialni zakon v ničemer ne razveljavlja OZ kot generalni zakon, ampak samo podrobneje ureja in dopolnjuje posamezne določbe.

Title:PROCEDURES OF ENFORCEMENT OF MATERIAL MISTAKES
Abstract:The obligation of the seller in the sales contract is the extradition proceedings, which is the quality in accordance with the contract, with no errors. The subject of the contract is a thing which may have defects. Defects can be legal or factual. The seller is responsible for defects if the legal conditions are fulfilled. Buyer shall review a thing in the usual way and inform the seller about a defects timely and properly. The buyer, who on time and properly notified the seller about the defects may require the seller to repair the defect or to deliver him another thing without defects (reaching agreement), reduction of the price, cancel the contract.It is a breach of indemnification, which buyer must enforce in time limit. If buyer miss the deadline, he loss his rights (claims), which go under this title. The buyer can exercise his rights from a clerical defect only if he timely information to the seller about the defect. Directive 1999/44/EC is the consumer directive at European level. OZ and ZVPot must be coordinated with this directive. ZVPot as a special law does not invalidate OZ, as a general law, but only supplement it and detail the specific provisions.
